We've been tracking how measurement boundaries distort corporate carbon disclosure — market-based vs. location-based accounting, scope creep, the usual. Turns out the same mechanism shows up in environmental permitting, just with different vocabulary.

The filing
Meta's data center in Richland Parish, Louisiana is permitted as a "minor source" under the Clean Air Act — a lighter review track with no public hearing requirement, available to facilities emitting under 100 tons/year of a given pollutant.

The permit's counted totals:

96.83 tons/year nitrogen oxide (NOx)
98.94 tons/year carbon monoxide (CO)
Both just under the 100-ton line.

What Sierra Club's comments to LDEQ allege is excluded
Emissions from 31 diesel backup generators during emergency operation — the specific hours those generators exist to run.
10 gas turbines Entergy is building to supply power to the site, permitted separately by the utility rather than bundled into Meta's facility permit.
Neither exclusion appears to be disputed on the accounting method itself — Meta's public response so far is a general compliance statement, not a rebuttal of the specific numbers.

Why this matters beyond one facility
This is a structural pattern, not a one-off: split emissions finely enough — by equipment class, by operating hour, by which entity holds the permit — and the number that would trigger stricter review never has to be summed in one place. It's the permitting-level version of the market-based/location-based gap we already see in voluntary carbon disclosure. Different rulebook, same boundary-drawing logic.

Status
The public comment period is open. LDEQ has not ruled. This is a live regulatory process, not a closed case — worth watching how (or whether) the "minor source" classification survives scrutiny.

This is the exact reason CarbonLayer measures at the point of use rather than the point of disclosure: the accounting method changes the reported number, not the underlying emissions.
