India just enacted its first legal framework for AI-generated content. The IT Amendment Rules 2026, published on February 12, represent a watershed moment in digital regulation, not just for India but for the global conversation about AI governance.

With 1.03 billion internet users, 800 million active social media accounts, and more than half the population getting news from platforms like WhatsApp and YouTube, India's approach to regulating synthetic content will have outsized influence on how the rest of the world tackles this problem.

The Scale of the Problem

Before examining the regulation, it is worth understanding the scale of what it aims to address.

When more than half of India's 1.03 billion internet users get news from social media, the potential for AI-generated misinformation to spread at scale is enormous.

What the IT Amendment Rules 2026 Actually Say

The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2026 build on the existing 2021 framework with several first-of-their-kind provisions.

1. Formal Definition of Synthetically Generated Information (SGI)

For the first time in Indian law, synthetically generated information has a formal legal definition. The rules target deepfakes and AI-generated impersonations while explicitly excluding routine edits like cropping, color correction, or basic filters. This distinction is important because it focuses regulatory energy on genuinely deceptive content rather than everyday media editing.

2. Mandatory Labeling and Metadata

All AI-generated images, videos, and audio must carry mandatory metadata or unique identifiers. Platforms are explicitly prohibited from removing or suppressing these labels. This creates a chain of accountability from content creation through distribution.

India's approach sits between the EU's comprehensive framework and the largely self-regulatory American model.

The EU's AI Act (effective 2024-2026 in phases) classifies AI systems by risk level and imposes transparency requirements, but with longer compliance timelines and less aggressive takedown requirements.

The United States has no federal AI content regulation as of 2026, relying instead on Section 230 protections for platforms and a patchwork of state-level laws.

China requires AI-generated content to be labeled and prohibits using AI to spread "fake news," with enforcement through its Cyberspace Administration.
