In 2019, ICE signed a $6.1 million contract with Palantir Technologies for a system called FALCON — Federated Analytics for Connectivity, Leads, and Organized Networks. By 2024, that system had expanded into something far more comprehensive: a predictive deportation infrastructure that ingests surveillance data, social media activity, utility records, financial transactions, and facial recognition feeds to identify, locate, and prioritize removal targets.
This isn't speculation. It's in the contracts.
The Data Architecture of Deportation
License plate readers: ICE contracts with Vigilant Solutions (now Motorola Solutions) for access to 8+ billion license plate scans from cameras across the country. Your car's movement history going back years.
Commercial data brokers: ICE purchases data from LexisNexis Risk Solutions and Thomson Reuters CLEAR — utility records, address history, phone records, financial data. No warrant required — it's commercial data.
DMV records + facial recognition: ICE and FBI agents have queried millions of driver's license photos via facial recognition. Most state legislatures never voted on this.
Social media monitoring: ICE uses platforms from Palantir, ShadowDragon, and Babel Street to aggregate social media and link accounts to real identities.
Fusion centers: 79 DHS intelligence fusion centers aggregate local law enforcement, federal records, and commercial intelligence into shared databases ICE can query.
How AI Changes Deportation Operations
Location prediction: License plate scanned 40 times at the same intersection every Tuesday? The system knows where you'll be next Tuesday.
Network mapping: Identify one removable person. The system surfaces everyone they live with, work with, or contact. One case becomes ten.
Priority scoring: AI scores individuals by "enforcement priority." Critics have documented racial and socioeconomic bias embedded in these scores.
The false positive problem: DHS OIG and Georgetown Law have documented significant error rates — especially for darker-skinned individuals, where facial recognition errors run 35+ percentage points higher.
The Surveillance Laundering Problem
ICE exploits legal gaps that predate AI:
- Third-party doctrine: Data you share with utilities, banks, apps loses Fourth Amendment protection. ICE buys it from brokers — no warrant needed.
- Mosaic effects: Individual data points are legal. 8 billion aggregated scans create surveillance the Supreme Court hasn't fully addressed.
- Administrative subpoenas: ICE can compel records without judicial approval.
You cannot opt out. You can't opt out of license plate scanning in public. You can't opt out of your utility records being sold. You can't opt out of facial recognition at ports of entry.
What the Data Shows
- 2019 OIG report: ICE case management systems had significant inaccuracies in alien file records
- 2021 GAO: DHS facial recognition programs lacked accuracy testing and privacy impact assessments
- Georgetown Law: Facial recognition error rates for Black women up to 35 percentage points higher than for white men
The system doesn't know it's making errors. It's doing exactly what it was trained to do.
The Opt-Out Problem
This is surveillance capitalism applied to state power: data collected for commercial purposes (ads, loans, navigation) is purchased by government for enforcement at a scale that would have required massive public investment to build from scratch.
The surveillance capitalism business model — collect everything, worry about use later — creates an infrastructure government can purchase instead of build.
What Needs to Change
- Warrant requirements for aggregate surveillance: Courts need to extend Carpenter v. United States to AI-aggregated commercial data
- Data broker regulation: Limit what brokers can sell to government without warrants (see: Fourth Amendment Is Not For Sale Act)
- Facial recognition moratoriums: Until bias auditing requirements are established
- Algorithmic impact assessments: Any AI system used in enforcement affecting liberty should require published accuracy audits

- Use privacy-preserving tools for browsing and communications
- Support ACLU and EFF litigation on AI surveillance
- Contact your representatives about the Fourth Amendment Is Not For Sale Act
