Location data — specifically the zip codes where an applicant lives, shops, and travels — has been used as a credit variable by multiple lenders. Education institution attended correlates strongly with race and class. Device type (iPhone vs. lower-cost Android) correlates with income and has been used as a signal. Time of day of loan application has been used. Browser type has been used.

These variables are not explicitly demographic. But they are not neutral.


4. Algorithmic Redlining: Modern Discrimination at Scale

Algorithmic Redlining is the reproduction of geographic and racial discrimination in AI lending models through the use of variables — zip code, neighborhood characteristics, shopping locations, social network geography — that correlate with race and ethnicity through the legacy of historical discrimination rather than any inherent connection to credit risk.

The term "redlining" derives from the literal practice of drawing red lines on city maps to designate neighborhoods — overwhelmingly Black and immigrant neighborhoods — where the Home Owners' Loan Corporation and private banks would not make loans in the 1930s through 1960s. The Fair Housing Act of 1968 made explicit geographic discrimination illegal. But the underlying geographic and wealth patterns that redlining created were never remediated, and AI models trained on those patterns can reproduce the discrimination through entirely facially neutral inputs.

The mechanism is straightforward. An AI model trained to predict loan default uses zip code as a variable. In that zip code data is encoded decades of disinvestment: lower property values (due to redlining), higher default rates (due to predatory lending in the 1990s and 2000s subprime era), lower income levels (due to school funding inequities tied to property tax), and lower business density (due to capital starvation). The model is not discriminating on the basis of race explicitly. But zip code is a nearly perfect proxy for race in many U.S. metropolitan areas, and the model's discrimination produces the same outcome as if it had used race directly.

The National Community Reinvestment Coalition, the Urban Institute, and academic researchers at the University of California Berkeley have documented that AI-underwritten mortgage loans show persistent racial disparities. A 2019 Berkeley analysis found that both face-to-face and algorithm-based mortgage lenders charge Black and Hispanic borrowers higher interest rates than similarly qualified white borrowers — but algorithm-based lenders show a smaller disparity in rejection rates while still showing significant disparities in pricing.

This distinction matters. Algorithmic lenders may approve more minority borrowers — but they may do so at higher rates that still extract disproportionate value from those borrowers. Inclusion at higher cost is not equity.

The HUD action against Facebook illustrates how the discrimination can operate outside the traditional lending context entirely. "My wife and I filed joint taxes, live in a community property state, and have been married for many years," Hansson wrote. "She has a better credit score than me, yet Apple Card gave her a 20x lower credit limit. It's a sexist program, even if no one at Goldman Sachs or Apple intended it to be."

The story spread when Apple co-founder Steve Wozniak posted that the same thing had happened to him and his wife. The New York Department of Financial Services launched an investigation.

The investigation concluded in 2021 without finding a violation of the Equal Credit Opportunity Act — because Goldman Sachs was able to demonstrate that the algorithm did not use gender as an input. But that finding obscures more than it reveals. The ECOA prohibits discrimination based on sex. This is easier demanded than delivered when the model is a gradient-boosted ensemble of 1,500 variables.


6. CFPB, ECOA, and the Right to an Explanation

Is AI credit scoring legal? Yes — but it is subject to the same anti-discrimination laws as any other lending method. The CFPB's 2022 circular made clear that this is not an acceptable excuse. The guidance stated that the ECOA and Regulation B's adverse action notice requirements apply to all credit decisions, regardless of the method used to make them. Lenders that use AI models must still be able to identify the principal reasons for adverse action — reasons that are specific, accurate, and based on the actual factors the model used. Citing the complexity of the model as a defense to an ECOA adverse action notice requirement is legally insufficient.

The CFPB has also moved aggressively on broader algorithmic fairness issues. Auto insurance AI pricing has been extensively documented as producing discriminatory outcomes. A 2017 ProPublica investigation found that in multiple states, major auto insurers charged Black, Hispanic, and Asian neighborhoods significantly higher premiums than white neighborhoods with the same accident risk profile — meaning the premium differential was not explained by actual claim frequency but by zip code demographics.
