Code as Norm: Algorithmic Governance and AI Ethics

The article analyzes the transition from traditional legal and social norms to technical architecture, where code becomes a form of ex ante behavioral control. The author argues that algorithms are not neutral but rather implement specific conceptions of the good encoded in their objective functions. Drawing on the thought of Michael Sandel and Chinese concepts such as Jilin (mechanical heart-mind), the text points to the risk of human instrumentalization and the loss of the internal goods of professional practices. The main thesis is that technocracy does not replace value conflicts with calculations, but rather hides political philosophy within system specifications. Consequently, a teleological analysis of AI is essential to prevent moral depersonalization and excessive optimization at the expense of dignity and interpersonal relationships.
