They haven't given up yet, They are still preparing to take down youtube-dl. They have sued hosting provider of youtube-dl with charges of facilitating piracy. They are also asking for ISPs for log on visitors of the website.
As you mentioned, DMCA was created in 1998, the world has changed with it, and now it has become a tool for the giants to control people. They blocked new artists claiming they have copied music, even when their tunes were older. They have blocked streamers for their background music. The whole system is rigged to be disadvantageous towards newcomers with no mean to defend themselves.
