Traumatic Brain Injury (TBI) under VA Diagnostic Code 8045 is one of the most under-rated conditions in the VA system — not because the evidence isn't there, but because the rating mechanism is poorly understood. TBI isn't rated as a single condition. It's rated on its residuals, and those residuals can unlock additional ratings.
How TBI Rating Actually Works
TBI is rated under 38 CFR § 4.124a, DC 8045 using a unique system: the 10 facets of neuropsychological functioning. Each facet is scored from 0–3, with the highest score determining the overall rating.

- Judgment
- Social interaction
- Orientation

The key rule: VA rates TBI on the single highest-scoring facet, not an average. If your memory/concentration is a Level 3 but everything else is Level 1, you get 40%.
Residuals That Unlock Additional Claims
Under DC 8045(e), if TBI residuals are addressed separately (sleep impairment, headaches, seizures, psychiatric symptoms), those are rated under their own diagnostic codes in addition to the TBI rating — no pyramiding prohibition applies when they are separately ratable.
High-yield TBI residuals to claim separately:
DC 8100 — Migraines
If TBI caused chronic headaches: rate separately. At "prostrating attacks occurring 4-14 times in 12 months" = 30% ($508/month). Prostrating attacks occurring more frequently = 50%.
DC 9411 — PTSD
Co-occurring TBI and PTSD: rate separately. VA cannot combine these into a single rating and claim pyramiding — the conditions are distinct.
DC 6847 — Sleep Apnea
Neurological TBI residuals affecting breathing during sleep: secondary claim to TBI with neurologist nexus letter. Strong connection when TBI affected brainstem function.
DC 8911 — Epilepsy/Seizures
Post-traumatic seizure disorder: DC 8911, rated on frequency. Even 2 major seizures in 12 months = 20%.
The PACT Act Connection
For veterans who served in OEF, OIF, or other post-9/11 theaters, TBI may qualify for presumptive service connection under the PACT Act — specifically for toxic exposure veterans who experienced blast exposure. The VA cannot require proof of a specific blast event when deployment records confirm service in a combat zone where IEDs were prevalent.
What the C&P Examiner Is Scoring
The DBQ for TBI is the most complex in the system. The examiner must document:
- Cognitive testing results (memory, attention, executive function)
- Behavioral/neurobehavioral observations
- Impact on daily activities and employment
- All residual conditions
Common mistake: Veterans present at C&P exams minimizing their symptoms. The VA rates what you demonstrate on the worst day, not the best. Document your functional impairment in writing before the exam.
Service Connection Pathways
Direct: In-service blast exposure, vehicle accident, training injury — documented in service treatment records or buddy statements
Presumptive (combat): Combat veterans don't need to document the specific incident. Service in a theater with documented blast exposure is sufficient.
Secondary to PTSD (reverse pathway): PTSD can cause neurological changes that mimic TBI residuals — some examiners diagnose TBI secondarily to PTSD when cognitive deficits are present without documented head trauma.
