Automating Schedule FA & Income Tax Rule 115 SBI TTBR Math for US RSUs & ESOPs (Fidelity / Schwab CSV Parser)

During the July ITR filing rush in India, tech professionals holding US Restricted Stock Units (RSUs) or Employee Stock Purchase Plans (ESPPs) across multinational technology firms (Microsoft, Google, Amazon, Adobe) face one of the most punishing compliance audits under the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015.

Section 42 and Section 43 of the Black Money Act impose a strict liability annual penalty of ₹10 Lakh for omitting or inaccurately reporting foreign assets under Schedule FA of ITR-2 or ITR-3—even if your foreign shares generated zero income and you have paid all taxes in full.

1. The Preceding Month-End SBI TTBR Nuance (Income Tax Rule 115)

When converting foreign currency stock values into Indian Rupees (INR), you cannot use the vesting date exchange rate shown on your Form 16, nor can you use closing market rates from Yahoo Finance or RBI reference rates.

Under Income Tax Rule 115, capital assets acquired abroad must be converted to INR strictly using the Telegraphic Transfer Buying Rate (TTBR) issued by the State Bank of India (SBI) on the last day of the month immediately preceding the month of acquisition.

For example:

  • If your Microsoft RSU vested on July 15, 2025, the acquisition rate must be the SBI TTBR on June 30, 2025.
  • If your ESPP shares were purchased on November 14, 2025, the acquisition rate must be the SBI TTBR on October 31, 2025.

When brokers like Fidelity NetBenefits, Charles Schwab, E-Trade, or Morgan Stanley issue transaction histories involving split lots, sell-to-cover withholding taxes, and reinvested dividend fractional shares (0.412 shares), manually mapping historical SBI TTBR rates across 50+ vesting tranches takes hours of error-prone manual calculation.


2. Table A2 (Custodial Accounts) vs. Table A3 (Equity & Debt Interest)

A common defect notice triggered under AIS/26AS matching stems from clubbing every balance into Table A3.

  • Table A3 (Foreign Equity and Debt Interest): Must contain your actual vested share holdings, including initial acquisition value (at preceding month-end SBI TTBR) and peak calendar-year valuation (at preceding month-end SBI TTBR).
  • Table A2 (Foreign Depository / Custodial Accounts): If your offshore brokerage account holds any uninvested cash, dividend sweeps, or fractional share cash proceeds alongside your shares, that cash balance must be separately reported under Table A2.

3. The Calendar Year vs. Indian Financial Year Window

Schedule FA operates strictly on the Calendar Year (January 1 to December 31) for jurisdictions where the tax year aligns with the calendar year (such as the United States).

When filing your Assessment Year (AY) 2026-27 tax return, you must report holdings and transactions specifically from the January 1, 2025 to December 31, 2025 window.
