We use E-Verify at TalentOp Systems LLC, and people often ask us what that means for them. Here are our plain answers, in short parts.
The short version
A company that uses E-Verify checks whether every new hire has the right to work in the United States. That is the whole job of the system.
What E-Verify is
E-Verify is a free online system from the U.S. government. Two agencies run it together: USCIS (U.S. Citizenship and Immigration Services) and the Social Security Administration (SSA).
How a check works
E-Verify works with Form I-9. Every employer must use Form I-9 to check a new worker's identity and right to work.
- The new hire fills out Form I-9.
- The employer types details from that form into E-Verify.
- E-Verify compares the details with records held by the Department of Homeland Security (DHS) and SSA.
- The employer usually gets an answer in a few seconds.
When the check happens
The check comes only after a person accepts a job offer and fills out Form I-9. A company may not run an E-Verify check on someone before that point.
When the records do not match
Now and then, the details do not match the records. The worker can take action to fix this. The e-verify.gov site explains what to do.
How to tell if a company uses E-Verify
There are two easy ways:
- The notice. Companies that use E-Verify must post an E-Verify participation notice where they hire, or share it with job application papers.
- The search tool. The E-Verify Employer Search on e-verify.gov lists employers that are enrolled. Each name comes from what the employer gave when it signed up. So search for both the legal name and the public name.
What E-Verify does not tell you
E-Verify only confirms that a new hire can work in the U.S.
- It is not a background check.
- It does not test skills or job requirements.
- It does not show whether a company sponsors visas. To learn that, ask the company directly. You can ask us at info@talentopsystems.com.
A note before you go
We share this as general background. TalentOp Systems LLC is not giving legal advice here. If you have a question about your own case, please talk it over with a licensed immigration attorney.
