Applying to switch employer whilst on Skilled Worker visa? How it works and what you should do..
If you want to change employer whilst on Skilled Worker visa, you'll need
- A new COS
- To make a fresh visa application
If you have dependents, they won't need to switch at the same time.
They can either switch
- At the same time as you
- Any time before the expiry of their current visa
You won't be able to work full time for your new employer until you have received your new visa.
(Whilst you wait you could work 20 hours per week supplementary employment with your new sponsor, if you meet the rules)
Here's the simplest way to do it
- Receive your new COS
- Make your visa application
- Once visa is secure, hand in your notice
- Work your notice period
- Switch to your new job
Your old sponsor will need to notify the Home Office of your last day of employment.
Your new employer will need to run a Right to Work check once
- You have your visa
- You begin full time employment
According to the rules, you're allowed to work out your contractual notice period with your old employer.
Extra Note
Your employer can set the work start date for your COS up to three months into the future from the date it is assigned.
If you receive your new visa before the work start date on your COS, you can start working for your new sponsor full-time.
Where your new employer is assigning a COS, setting the work start date at least 6-8 weeks in advance will give you more flexibility.
