PIPEDA Compliance: Canada's Privacy Law Explained for Businesses
GDPR gets all the attention. The headlines, the fines, the cookie banner panic — it's all GDPR. But if your business touches Canadian personal data, there's another law you need to understand: PIPEDA. Canada's federal privacy law has been in force since 2004, has real enforcement teeth, and applies to far more businesses than most assume. What Is PIPEDA?
PIPEDA stands for the Personal Information Protection and Electronic Documents Act. It's Canada's federal private-sector privacy law, enacted in 2000 and fully in force since 2004. PIPEDA governs how private-sector organisations collect, use, and disclose personal information in the course of commercial activity.
PIPEDA compliance is required for any organisation that collects, uses, or discloses personal information as part of commercial activities — including many organisations headquartered outside Canada.
The law is administered by the Office of the Privacy Commissioner of Canada (OPC). While the OPC historically relied on persuasion and recommendations rather than binding orders, amendments under the Digital Privacy Act (2015) expanded enforcement powers and introduced mandatory breach notification requirements.
Who Must Comply With PIPEDA?
PIPEDA compliance obligations apply to:
- Canadian private-sector organisations that collect, use, or disclose personal information in the course of commercial activities
- Foreign companies that collect personal information from Canadian residents in the course of commercial activity — even if the company has no physical presence in Canada
- Federal works and undertakings (airlines, banks, telecoms) regardless of whether they conduct commercial activities
PIPEDA does not apply to:
- Government institutions (covered by the Privacy Act)
- Non-commercial activities of non-profit organisations
- Purely personal or domestic activities
- Provincially regulated organisations in provinces with substantially similar legislation (Alberta, British Columbia, and Quebec have their own private-sector privacy laws)

The 10 Fair Information Principles
PIPEDA compliance is built around 10 Fair Information Principles drawn from the Canadian Standards Association's Model Code for the Protection of Personal Information. These principles form Schedule 1 of the Act and define what compliance looks like in practice.
1. Accountability
An organisation is responsible for personal information under its control. It must designate an individual — a Chief Privacy Officer or equivalent — accountable for the organisation's compliance with PIPEDA. This includes third-party processors: if you share data with a vendor, you remain responsible for how they handle it.
In practice: Designate a privacy officer, draft internal privacy policies, and include data protection provisions in your vendor contracts.
2. Identifying Purposes
The purposes for which personal information is collected must be identified at or before the time of collection. You cannot collect data first and figure out the use later.
In practice: Clearly document why you collect each category of data. Your privacy policy and collection points (forms, checkout pages, app onboarding) must state the purpose.
3. Consent
The knowledge and consent of the individual are required for the collection, use, or disclosure of personal information — except where inappropriate. PIPEDA uses an opt-out model for many uses (unlike GDPR's opt-in for non-essential processing), but consent must still be meaningful, informed, and capable of being withdrawn.
In practice: Consent can be express or implied, but the type required depends on sensitivity. Financial or health data requires express consent. More routine commercial uses may operate on implied consent — but you must make it easy to withdraw.
4. Limiting Collection
Personal information must be collected only for the purposes identified, and only as much as is necessary. This mirrors GDPR's data minimisation principle.
In practice: Audit your forms and analytics. If you collect phone numbers but never use them, stop. If your analytics platform sends more data than you need, configure it to send less.
5. Limiting Use, Disclosure, and Retention
Personal information must not be used or disclosed for purposes other than those for which it was collected, except with consent or as required by law. Information must be retained only as long as necessary to fulfil those purposes.
In practice: Set data retention schedules. Document them. Have a process for deleting or anonymising data that is no longer needed.
6. Accuracy
Personal information must be as accurate, complete, and up-to-date as is necessary for the purposes for which it is used.
In practice: Give users a way to update their information. If you make decisions based on customer data, have a process for corrections.
7. Safeguards
Personal information must be protected by security safeguards appropriate to the sensitivity of the information. This includes protection against loss or theft, and against unauthorised access, disclosure, copying, use, or modification.
In practice: Use encryption in transit and at rest. Implement access controls. Have an incident response plan. Train staff on data handling.
8. Openness
An organisation's policies and practices relating to the management of personal information must be readily available. PIPEDA compliance requires transparency about your data practices.
In practice: Maintain a clear, accessible privacy policy. Make it easy to find on your website. Don't bury it in legal jargon.
9. Individual Access
Upon request, an individual must be informed of the existence, use, and disclosure of their personal information and be given access to that information. Individuals can challenge the accuracy of information and have it amended.
In practice: Build a process for responding to access requests. PIPEDA does not specify a deadline (unlike GDPR's 30 days), but the OPC expects "timely" responses — generally interpreted as within 30 days.
10. Challenging Compliance
An individual must be able to address a challenge concerning compliance with PIPEDA to the designated individual responsible for the organisation's PIPEDA compliance.
In practice: Make it easy for people to raise privacy concerns. Provide contact information for your privacy officer or privacy team.
PIPEDA vs GDPR: Key Differences
PIPEDA compliance and GDPR compliance overlap significantly in principle, but differ meaningfully in mechanism and enforcement. Understanding the differences matters if your business operates across both Canadian and European users.

The consent model difference is significant. PIPEDA allows implied consent for lower-sensitivity commercial uses — meaning a newsletter signup by email could give implied consent for related marketing communications. GDPR requires explicit, granular, pre-checked-off consent for marketing. If your business serves both markets, the safe approach is to apply the stricter GDPR standard globally.
The enforcement style has also historically differed. GDPR regulators (DPAs) can levy massive fines directly. The OPC historically issued recommendations and investigated complaints but could not issue binding orders. That is changing under Bill C-27.
Bill C-27 and the Consumer Privacy Protection Act (CPPA)
The most significant development in Canadian privacy law is Bill C-27, which proposes to replace PIPEDA with the Consumer Privacy Protection Act (CPPA). As of early 2026, Bill C-27 is progressing through Parliament. When enacted, it will substantially modernise Canada's privacy framework.
Key changes under the CPPA:
- Mandatory opt-in consent for sensitive personal information and secondary uses — moving Canada closer to GDPR's model
- Direct enforcement powers for the OPC, including the ability to issue fines of up to CAD $25 million or 5% of global revenue

- De-identification requirements — specific standards for anonymising data

Organisations that achieve strong PIPEDA compliance now will be better positioned when the CPPA comes into force. The core principles remain the same; the enforcement mechanism and individual rights become significantly stronger.
Breach Notification Requirements Under PIPEDA
Since November 2018, PIPEDA requires organisations to report data breaches that create a real risk of significant harm to individuals, and to notify affected individuals.
What triggers notification:
A breach triggers notification when there is a real risk of significant harm. Factors considered include:
- Sensitivity of the personal information involved
- Probability that the information has been or will be misused
- Number of individuals affected
- Nature of the harm that could result
Significant harm includes bodily harm, humiliation, damage to reputation, financial loss, identity theft, negative effects on credit records, and damage to relationships.
Who you must notify:
- The Office of the Privacy Commissioner of Canada — as soon as feasible after the breach
- Affected individuals — as soon as feasible once you determine there is real risk of significant harm
- Other organisations that may be able to reduce risk to affected individuals (e.g., a credit reporting agency if financial data was breached)
Record-keeping:
PIPEDA requires organisations to maintain a record of every breach of security safeguards involving personal information — regardless of whether notification was required. Records must be retained for 24 months and made available to the OPC on request.
This is stricter than many businesses realise: you must document all breaches, even minor ones that don't meet the notification threshold.
Privacy Policy Requirements Under PIPEDA
PIPEDA compliance requires a privacy policy that is readily available to the public. Unlike some jurisdictions, PIPEDA does not specify mandatory clauses, but the 10 Fair Information Principles dictate what it must address.
A PIPEDA-compliant privacy policy should include:
- What personal information you collect — categories of data, including information collected automatically (cookies, IP addresses, analytics)
- Why you collect it — specific purposes for each category
- How you use it — including any secondary uses
- Who you share it with — third parties, service providers, and why

Individual Access Rights Under PIPEDA
PIPEDA grants individuals the right to:
- Know whether you hold personal information about them
- Access that information and understand how it was used and disclosed
- Challenge the accuracy of the information and request correction
Handling access requests:
- Respond within a reasonable timeframe — the OPC treats 30 days as a benchmark
- Provide information in an understandable format
- Do not charge a fee (or if you do, disclose it upfront and keep it reasonable)
- Explain any portions you are withholding and why
Grounds for refusing access:
PIPEDA allows organisations to refuse or limit access when:
- The information is protected by solicitor-client privilege
- Disclosure would reveal confidential commercial information
- The information was collected during an investigation
- Disclosure could threaten the life or safety of another person
When someone challenges accuracy:
If someone demonstrates that information is inaccurate, you must correct it and notify any third parties to whom the incorrect information was disclosed.
Practical Checklist: 8 Steps to PIPEDA Compliance
PIPEDA compliance doesn't require a legal team. Here's a practical roadmap:
Designate a privacy officer — Name someone responsible for PIPEDA compliance. For a small business, this can be the founder or a senior operations person. Document the designation.

Implement data retention schedules — For each category of data, define how long you keep it. Build a process (or configure your tools) to delete or anonymise data that exceeds the retention period.
Secure your data — Encrypt personal information in transit and at rest. Implement access controls. Conduct periodic security reviews.
Build a breach response process — Document what constitutes a breach, who is responsible for the response, how to assess real risk of significant harm, and how to notify the OPC and affected individuals. Maintain a breach log.
Build an access request process — Know how to respond when someone asks for their data. Have a template response, a 30-day turnaround target, and a process for corrections.
