DBAD license stands for Don't be a d*ck
, which intended for a safer modification of WTFPL license (which is of ALLOW ALL kind)
As developers we all want to protect our code from d*cks that try to steal, sell, infringe or just generally rip us off.
So, the real problem here is, some people are d*cks that either abuse the law system, or lack thereof.
I also realize that there is also soft plagiarism, unintentional or real d*ck as well.
Also, I recently come across hiQ vs LinkedIn, and my thought is that
- Whether originally intended or not, when you let the client sign the tl;dr ToS, you can always make it a legal case. (So, unfair ToS is totally possible. In contrast, not sure if legal man totally think everything in advance, so sometimes overdone, sometimes under.)
- When it is a decided lawsuit, people will try to win, rather than listening. (Probably as losing will affect ALL stakeholders, regardless of reasons.) At that time, both sides decided to be a d*ck.
- Isn't that also the case with LICENSE, and when you decided to take a legal action?
