A Pre-Start Work Permit Checklist for Canadian Tech Teams

Titanium Law guide to open and employer-specific work permits in Canada, with website and phone

A Canadian technology team can approve a start date in its HR system long before it has checked whether a new hire may legally work under that specific permit. The distinction between an open and an employer-specific work permit is a useful first branch in an onboarding checklist, but the printed conditions still control.

A permit type is not a complete authorization model

IRCC says an open work permit usually permits work for most eligible employers, subject to restrictions. Eligibility for an open permit is limited to particular situations; an applicant cannot assume one is available because a job offer exists. A permit can restrict the occupation or location.

An employer-specific permit can list the employer, occupation and location under Additional Information, with further Conditions and Remarks. A new company, changed duties or work location can require a new permit or changed conditions. A similar job title in two HR systems does not settle the question.

Build a pre-start review, not an automated yes/no rule

A useful checklist for a developer, recruiter or HR operations team is:

  1. Capture the expiry date and the actual employer, occupation, location and restrictions printed on the permit. Protect this personal information with limited access.
  2. Compare those terms with the proposed role, reporting location and expected work arrangement, including hybrid or remote work.
  3. Ask the responsible immigration professional whether a new employer-specific permit or another route is needed. Do not derive eligibility solely from the document label.
  4. If a new application is required, record whether IRCC has issued a separate work-authorization email under its interim process. An application receipt alone is not that authorization.
  5. Keep an expiry reminder separate from a job-change workflow. Maintained status generally preserves work under the same existing conditions when its requirements are met; it does not automatically authorize a different employer.

If the previous employer-specific job has ended, IRCC says the worker must stop working until a new permit is approved or IRCC sends a work-authorization email under the applicable process. This is why an onboarding system should allow a “pending authorization” state rather than forcing a start date.
