Image generators do not respond uniformly to requests involving copyrighted characters.
Google’s Gemini produced images nearly identical to The Gruffalo, while ChatGPT refused direct requests but generated a generic image from a description without the character’s name.
Illustrator Axel Scheffler is considering legal action; whether such outputs infringe copyright remains for courts to decide.
Different restrictions on systems
Tests have shown that ChatGPT and Google's Gemini handle different requests for creating protected character images.
When asked directly by ChatGPT to create images of the Gruffalo, he refused. When given a description of the character without mentioning his name, he created a different, generic image.
Gemini, on the other hand, produced images almost identical to the Gruffalo after requests. It also created an image of the book's cover, as well as an image of the Gruffalo at an Oktoberfest event, wearing traditional costume and drinking beer.
The question of copyright
Whether the creation of such images violates copyright remains to be decided by the courts.
