FERPA's Blind Spot: Why Your School's AI Tools Know More Than Your Doctor

Somewhere in a data center you'll never visit, there is a file on your child.

It contains their grades, their behavioral scores, their reading speed, their GPS location at 8:47 AM on a Tuesday, the number of times they fidgeted during a test, the keystroke patterns that reveal when they're anxious, and the moment they Googled something they were too embarrassed to ask a teacher.

This file was built legally. By companies you've heard of. With your school's permission. And it will follow your child for decades.

Welcome to the EdTech surveillance industrial complex.


FERPA's Fatal Flaw: The Law That Was Supposed to Protect Students

In 1974, Congress passed the Family Educational Rights and Privacy Act (FERPA). The goal was simple: students and parents have the right to access educational records, and schools cannot share those records without consent.

That was before the internet. Before cloud software. Before Silicon Valley discovered that children are among the most valuable behavioral datasets on earth.

FERPA has a loophole big enough to drive a data center through.

The "school official" exception allows schools to share student records with any company that has a "legitimate educational interest" and is under the school's direct control. In 1974, this meant the district superintendent or the school nurse.

In 2026, this means any software vendor who has signed a contract with the school.

The 2012 FERPA amendments made this worse. They redefined "school officials" to explicitly include contractors, consultants, and volunteers — essentially creating a legal framework that lets schools outsource student data to any company that writes the right contract language.

The result: your child's data is legally shareable with thousands of companies, as long as a school administrator clicked "agree" on a terms-of-service page.

There is no meaningful consent. There is no audit. There is no enforcement.

The Department of Education has issued exactly zero fines under FERPA in its 50-year history.


The PowerSchool Breach: 62 Million Student Records Stolen

In December 2024, attackers accessed PowerSchool's customer support portal using stolen credentials. The breach was disclosed in January 2025.

PowerSchool is not a company most parents have heard of. But it serves 18,000+ schools and more than 60 million students across North America. It is the dominant student information system — the database that tracks grades, attendance, disciplinary records, health information, and contact details for the majority of American K-12 students.

The attackers exported data from the students and teachers database tables. For many districts, that included:

  • Full legal names
  • Home addresses
  • Date of birth
  • Social Security numbers
  • Medical records and IEP/504 accommodation data
  • Academic history
  • Parent/guardian contact information

PowerSchool reportedly paid a ransom to prevent the data from being published. The attackers provided a video "proof of deletion." Security researchers noted that paying ransoms does not guarantee data is actually deleted.

62 million students. Medical records. SSNs. Ransom paid. No federal fine. No regulatory action.

This is the largest education data breach in history. It received a fraction of the coverage of a comparable corporate breach. Because children don't vote, and their data doesn't feel urgent until it does — when a 19-year-old discovers their SSN is already burned, when a college application is flagged, when identity theft surfaces from a breach that happened when they were 8.


Google's Classroom: 170 Million Students

Google Workspace for Education is used by an estimated 170 million students worldwide. It's free for schools. It includes Gmail, Docs, Drive, Meet, Classroom, and Chrome management tools.

Google's official position: no ad targeting in EDU accounts. Students' data is not used to build ad profiles.

Here's what Google does collect from education accounts (per their own documentation):

  • Service usage data (what features are used, when, how often)
  • Device information and identifiers
  • Location data (if enabled by admin)
  • In products like YouTube (even when accessed through a school account), watch history and behavioral signals
  • Diagnostic data from ChromeOS devices

The Student Privacy Pledge — a voluntary commitment signed by hundreds of ed-tech companies including Google — prohibits targeted advertising. It has no legal enforcement mechanism. The pledge is administered by the Future of Privacy Forum, a think tank substantially funded by Google, Apple, Microsoft, and Amazon.

This is the privacy fox guarding the student data henhouse.

In 2022, the New Mexico Attorney General sued Google for collecting data from children through apps like YouTube Kids, alleging violations of COPPA (Children's Online Privacy Protection Act). The case settled in 2023 for an undisclosed amount. Google did not admit wrongdoing.

But here's what matters most: even if Google never serves a single targeted ad to a student, the behavioral data collected during 13 years of K-12 education is extraordinarily valuable. It reveals learning styles, attention patterns, interests, anxieties, social dynamics. That data doesn't disappear when the student graduates.


ClassDojo: Behavioral Scoring 95% of American Children

ClassDojo is used in 95% of US K-8 schools. That statistic is not a typo.

The app lets teachers assign positive or negative behavior points in real time. "Good Teamwork" (+1). "Disrupting class" (-1). Parents can watch their child's behavioral score update live on their phones.

What ClassDojo collects:

  • Behavioral scores (detailed behavioral data going back years)
  • Photos and videos uploaded by teachers (including images of children)
  • Device identifiers and IP addresses
  • Messaging between parents, teachers, and school administrators
  • Portfolio content created by students

ClassDojo's privacy policy permits sharing data with third-party "service providers and partners." The company was acquired by various investors and has raised over $100 million in venture funding. The data asset — behavioral profiles of 95% of American children — is central to that valuation.

A behavioral score assigned to a 7-year-old is not educational data. It is a personality profile. And it is being built by a VC-backed company with investors who expect returns.


AI Proctoring: Biometrics From Your Bedroom

The COVID-19 pandemic accelerated one of the most invasive ed-tech deployments in history: AI-powered remote proctoring.

Proctorio and ExamSoft are the dominant players. Here's what they require:

  • A webcam recording of the student's face for the duration of the exam
  • Eye-tracking analysis (looking away from the screen = flagged as cheating)
  • Keystroke logging
  • Full screen recording
  • Access to the student's network, running processes, and file system
  • In some configurations, a 360-degree room scan before the exam begins

ExamSoft requires students to submit a selfie alongside a government-issued photo ID before every exam. This biometric data is stored on ExamSoft's servers.

In 2020, a security researcher discovered that Proctorio was sending student behavioral data — eye movements, gaze patterns, head position data — to third-party analytics servers in addition to the exam platform. The company disputed the characterization but did not deny the data transmission.

Illinois, with its Biometric Information Privacy Act (BIPA), is the only state with legal teeth for this kind of data collection. Students in 49 other states have no meaningful recourse.

AI proctoring analyzes your face, your eye movements, your room, your files — from inside your home — and stores that biometric data indefinitely.

This is not a conspiracy theory. It is in the terms of service that students must accept to take their exams.


The Clever Aggregation Problem

Most schools use dozens of EdTech applications. Each has its own privacy policy, its own data retention schedule, its own security posture.

This is the same aggregation problem that makes data brokers so dangerous in adult life. It's been replicated for children, at school scale, with a legal framework that explicitly permits it.


What Happens at 18: The Permanent Record Is Real

When a student turns 18, FERPA rights transfer from parents to the student. They can request their own records. They can request corrections.

What they cannot do is make the data disappear.

The commercial ed-tech ecosystem has no obligation to delete data when a student ages out. ClassDojo behavioral scores from 2nd grade. Proctorio eye-tracking sessions from high school exams. PowerSchool health records. Clever application usage logs.

Data brokers have begun aggregating educational data with consumer data, employment data, and financial data. LexisNexis, Acxiom, and similar companies build comprehensive profiles that combine records from dozens of sources.

Insurance companies use algorithmic risk scoring. Employers use background check aggregators. Credit bureaus are beginning to incorporate "alternative data" — behavioral signals from non-traditional sources.

The behavioral profile built on a child during 13 years of K-12 education does not stay in the school district's servers. It fragments, aggregates, and resurfaces in contexts its original subjects cannot anticipate.


The AI Acceleration: When EdTech Gets a Brain

Every dynamic described above is about to get dramatically more powerful.

Khanmigo — Khan Academy's AI tutor — engages students in extended conversations about academic subjects and personal struggles. These conversations are stored. They reveal cognitive patterns, emotional states, and personal circumstances that no standardized test could capture.

AI essay grading tools analyze writing style, vocabulary, sentence structure, and argument patterns. They build individualized writing fingerprints. Those fingerprints are useful for plagiarism detection — and for identifying students across contexts.

AI "engagement" systems claim to detect student attention levels from webcam feeds during remote learning. They flag "low engagement" and report it to teachers and administrators. The underlying facial analysis data is processed by third-party computer vision APIs.

School districts are deploying AI threat detection systems that monitor student communications — emails, chats, documents — for keywords associated with violence or self-harm. These systems read every student message, flag anomalies, and in some implementations alert law enforcement automatically.

The stated goal — student safety — is legitimate. The implementation — mass surveillance of all student communications — creates a surveillance apparatus that would have been unimaginable to FERPA's authors.


What Parents Can Do

The legal landscape is not entirely helpless, though it is deeply inadequate.

Know your FERPA rights:

  • You can request your child's complete educational record at any time
  • You can request corrections to factual errors
  • You can opt out of directory information sharing (name, address, phone number shared publicly)
  • You cannot opt out of sharing with school officials — but you can ask the school for a list of all vendors with school official designation

State laws that actually have teeth:

  • California SOPIPA (Student Online Personal Information Protection Act) — prohibits ed-tech companies from using student data for advertising or selling student data
  • New York Ed Law 2-d — requires schools to publish data privacy agreements with vendors; vendors must implement security practices
  • Illinois BIPA — biometric data (facial recognition, eye tracking) requires explicit consent

Practical steps:

  1. Email your school's data privacy officer and ask for a complete list of third-party vendors who have school official access to student records
  2. Review your district's data privacy agreements (many are published under state transparency laws)
  3. Ask specifically about AI proctoring tools, behavioral tracking apps, and any vendor that collects biometric data
  4. For your own AI interactions involving your child's information: use privacy-preserving tools that scrub PII before data reaches AI providers

The EdTech surveillance crisis is not primarily a technology problem. Technology is neutral. The crisis is structural:

  1. Schools are not equipped to evaluate vendor privacy practices. Most districts have no dedicated data privacy officer.

  2. FERPA is 50 years old and has never been meaningfully updated for the cloud software era.

  3. The business model of free software requires a data asset. When a company offers a free platform to schools, students are the product — even when the company sincerely believes it's doing good.

  4. Children cannot consent. They cannot read privacy policies. They cannot refuse to use the tools their teachers require. They have no agency in the system that surveils them.

  5. Enforcement doesn't exist. Zero FERPA fines in 50 years. Voluntary pledges with no legal weight. State laws that vary wildly and don't cross borders.

Every AI interaction is a data collection event. Every EdTech deployment is a surveillance apparatus. Every behavioral score is a profile point that follows a child into adulthood.

The permanent record is real. It just doesn't look like a manila folder anymore.
