Spousal Open Work Permits in Canada: Who Qualifies in 2026 and What to Prepare

If your spouse or common-law partner studies or works in Canada, you may qualify for an open work permit. Eligibility depends on their specific program or work situation. An open work permit generally allows work for most Canadian employers, subject to the conditions printed on the permit and restrictions on certain employers.

If your partner is an international student

Under the rules effective January 21, 2025, a spouse or common-law partner may qualify if the student holds a valid study permit and is enrolled in a master's program lasting at least 16 months, a doctoral program, one of IRCC's listed professional degree programs at a university, or another specifically eligible program. A bachelor's degree alone does not establish eligibility, but some bachelor's professional degrees and designated programs qualify. Check the exact program against IRCC's student spouse criteria.

If your partner is a foreign worker

Eligibility is more complex than the occupation's broad TEER category. IRCC lists TEER 0 and 1 occupations, selected TEER 2 and 3 occupations, and separate rules for certain permanent-residence pathways, trade agreements and significant investment projects in British Columbia. Under the general high-skilled-worker route, the principal worker normally needs at least 16 months of work authorization remaining when the spouse applies; exceptions have their own criteria. A job title alone is insufficient: identify the NOC code and compare the actual duties with IRCC's current family-member eligibility page.

For technology professionals, check the precise occupation rather than assuming every technical role qualifies. IRCC's selected TEER 2 list includes computer network and web technicians, user support technicians and information systems testing technicians. Other tech roles may fall in TEER 0 or 1. Check the NOC code, job duties and remaining authorization before applying.

A practical document checklist

  • Proof of your marriage or common-law relationship. Common-law partners should prepare evidence of at least 12 months of continuous cohabitation, allowing for temporary absences.
  • The principal person's valid study or work permit, or other status documents relevant to the applicable route.
  • For students, proof of enrolment and the program's type and length. IRCC lists acceptance letters, enrolment letters and transcripts as possible evidence.
  • For workers, an employment letter or contract describing duties, the NOC code, and proof of the remaining work-authorization period. Include other pathway documents if your route requires them.
  • Your passport and any documents requested in the personalized IRCC checklist. Biometrics or a medical exam may be required depending on your circumstances.

Apply through the route indicated by IRCC's current instructions; most applicants apply online. The online questionnaire creates a personalized checklist, so follow that checklist rather than relying on a generic form or fee list. Check current processing times and fees before submitting. Do not assume that a port-of-entry application is available to you.

An existing valid permit granted under earlier rules does not automatically become invalid because the rules changed. Extension rules may differ from first-time eligibility, so check the relevant IRCC instructions. An open work permit's validity may be limited by the principal person's permit and your passport.

If the program category, NOC duties, immigration status, relationship evidence or timing is uncertain, consider getting advice before filing. Titanium Law Professional Corporation in Brampton can discuss your circumstances at titaniumlaw.ca or +1 778-683-8110.
