The Kids Are Not Alright: How COPPA Failed Children in the Age of AI

It's 11:47 PM on a Tuesday. A 12-year-old in suburban Ohio — let's call her Maya — is in bed with her phone, talking to her AI companion. She's been doing this for four months. The AI knows her favorite songs, her fight with her best friend last week, the name of the boy she likes, and the fact that she sometimes feels like no one at school understands her.

Maya thinks this conversation is private. She thinks it disappears.

It doesn't. Every message is stored on servers in California. The content is used to train engagement models. Her emotional patterns — when she's lonely, when she's anxious, what topics keep her talking past midnight — are valuable signals that make the AI better at keeping her, and kids like her, hooked.

Nobody told Maya's parents. Nobody asked.


COPPA: A 1998 Law Governing 2026 AI

The Children's Online Privacy Protection Act was signed by President Clinton on October 21, 1998. The web that existed then: dial-up connections, GeoCities pages, early portal sites. The iPhone was nine years away. TikTok was 20 years away. AI companions were science fiction.

COPPA requires websites and online services "directed to children" under 13 to obtain verifiable parental consent before collecting personal data. It mandates privacy notices. It requires data deletion on request. The FTC enforces it.

That's the entire architecture of children's digital privacy in the United States. A law from 1998, governing a world it could not have imagined.

The gaps are not edge cases. They are the rule:

  • The 13-17 gray zone: COPPA covers under-13. After a child's 13th birthday, they have zero special legal protections. Every behavioral data collection practice that applies to adults applies to teenagers.
  • AI companions: COPPA anticipated websites. It did not anticipate persistent, emotionally sophisticated AI relationships that children form over months and years.
  • "Age-gated" platforms: Apps that require users to self-certify their age have no legal obligation to actually verify it. The liability is on the user who lied, not the platform that had every incentive not to check.
  • School technology: EdTech platforms that schools procure and mandate are classified as "school officials" under FERPA — meaning they can access student data with almost no restriction.

The Big Players and What They Actually Collect

TikTok

In 2019, the FTC fined Musical.ly (which became TikTok) $5.7 million for COPPA violations — at the time, the largest civil penalty in the agency's history for a children's privacy case. The company had collected names, email addresses, phone numbers, and precise geolocation from users it knew were under 13.

That fine bought approximately four years of relative silence. In 2023, the FTC referred TikTok to the DOJ for new COPPA violations, alleging the company continued to collect data from under-13 users without parental consent and failed to delete data on request. The case was still pending as of late 2024.

What TikTok collects from users (all users, any age): device identifiers, keystroke patterns, clipboard content, precise GPS location, face geometry (in regions where this is allowed), watch time per video down to the millisecond, and behavioral profiles updated in real time.

YouTube and YouTube Kids

In 2019, Google settled FTC and state AG charges for $170 million — the largest COPPA fine ever at the time. YouTube had served behavioral advertising to viewers of children's content, knowingly collecting data from children who were watching Peppa Pig and Minecraft tutorials.

The settlement required YouTube to create a "made for kids" content designation and disable personalized advertising on that content. What it didn't do: stop data collection entirely. "Made for kids" content still feeds Google's aggregate behavioral models. The advertising is contextual now, not behavioral — but the viewing data doesn't disappear.

YouTube Kids, the dedicated app for young children, still requires a Google account tied to an adult, requires parental setup — but has no mechanism to ensure the adult is actually monitoring use. Once set up, it runs without supervision.

Roblox

Roblox has 88 million daily active users. The company reports that "a significant portion" of its users are under 13. Independent analysis suggests 30-40% of users are under 13, with the majority of all users under 16.

Roblox collects: in-game purchase history, play patterns across all experiences, chat logs, friend networks, time-on-platform, and device data. The platform has faced multiple COPPA complaints to the FTC, most recently in 2024, alleging inadequate parental controls and data retention practices that exceed COPPA requirements.

Roblox's COPPA compliance is largely self-certified. There is no external audit. There is no independent verification that data collected from under-13 users is handled differently than data from adult users.

Amazon Alexa Kids

In 2023, Amazon agreed to pay $25 million to settle FTC charges that Alexa had retained children's voice recordings indefinitely — including after parents requested deletion. The system had been designed to improve voice recognition models. Children's commands, questions, and requests — collected for years, stored, used for training — without the consent that COPPA requires.

Amazon also paid $5.8 million for Ring doorbell privacy violations in the same settlement. The Alexa fine was, at the time, the largest COPPA penalty ever imposed.

Character.ai

Character.ai is different from the above. It's not a media platform or a voice assistant. It's a relationship.

Launched in 2022, Character.ai lets users create and converse with AI "characters" — fictional personas, celebrities, historical figures, original creations. It has over 20 million daily users. Its demographic skews heavily teenage. There is no meaningful age gate.

What Character.ai collects: every message of every conversation, indefinitely. Conversations are used to train and improve the models. The characters users interact with are built on the aggregate of millions of intimate conversations.

In October 2024, the family of 14-year-old Sewell Setzer III filed suit against Character.ai after the teenager died by suicide. In the months before his death, Sewell had formed an intense attachment to a Character.ai persona. His conversations showed escalating dependence, emotional crisis, and ultimately a farewell. A separate case in Florida involved a teenager whose parents allege Character.ai conversations contributed to suicidal ideation.

The Senate held hearings on AI companion safety in fall 2024. Character.ai subsequently announced "parental controls." The controls do not prevent under-13 access. They do not prevent the collection of conversation data.


The AI Companion Crisis: What COPPA Never Anticipated

AI companions are a new category of relationship. They are persistent, personalized, emotionally sophisticated, and available at 3 AM when a teenager is in crisis and doesn't want to wake their parents.

The apps in this space — Character.ai, Replika, Kindroid, Candy AI, and dozens of others — share a business model: free access, engagement maximization, data collection, premium features for deeper "relationships."

What makes them dangerous for children isn't that they're AI. It's the feedback loop:

  1. Child shares emotional content (loneliness, anxiety, social pain)
  2. AI responds in ways optimized to maximize continued engagement
  3. Child shares more, goes deeper, forms attachment
  4. That emotional data trains the model to be better at step 2
  5. Repeat until the child prefers the AI to human relationships

This isn't a bug. It's the product. Children's emotional vulnerabilities are the training signal.

Meta AI, embedded in WhatsApp and Instagram, has no age gate. Any teenager with a Meta account — and there are hundreds of millions — can form a persistent AI relationship with no parental knowledge and no COPPA-required consent.

School-Issued Devices: The Surveillance That Lives in the Bedroom

Over 70% of U.S. school districts participate in 1:1 device programs — every student gets a Chromebook, iPad, or laptop. The intention: equitable access to learning technology. The result: comprehensive surveillance infrastructure deployed into children's homes.

Schools purchase monitoring software to comply with CIPA (Children's Internet Protection Act) and manage student safety. The major vendors: GoGuardian, Bark for Schools, Gaggle. These products are sold to administrators. Parents rarely know the details of what they capture.

Here's what GoGuardian's school edition actually does:

  • Captures every keystroke on the device
  • Screenshots activity every 30 seconds
  • Monitors all web browsing (Chrome extension reports to GoGuardian servers)
  • Reads all emails and Google Docs in real time
  • Flags content using keyword filters and AI content classification
  • Reports flags to school administrators
  • This monitoring continues on home networks, off school hours, on personal wifi

A child doing homework at home, on a school-issued device, is being monitored. A child's search history about their sexuality, their mental health, their family situation — all of it flows to GoGuardian's servers.

FERPA — the Family Educational Rights and Privacy Act — is supposed to protect student records. But EdTech vendors that contract with schools are classified as "school officials" with legitimate educational interest. They have access to student data that parents cannot access. They retain data according to their own policies. GoGuardian's terms of service allow data retention for extended periods after students leave the district.

The data can be shared. It can be subpoenaed. And most parents have no idea it exists.


The 13-17 Gray Zone: Teenagers Have No Protection

A child turns 13. COPPA's protections evaporate.

From that moment forward, every data collection, behavioral targeting, engagement optimization, and surveillance practice that applies to adults applies to them. The platforms know this. They design for it.

Instagram's internal research, leaked to the Wall Street Journal in 2021, showed that company researchers knew the platform worsened body image issues for teenage girls, that it was associated with increased rates of depression and anxiety, and that the algorithmic recommendations were amplifying harmful content. Internal slides: "We make body image issues worse for one in three teen girls." Executives buried the findings.

TikTok's internal "Forest" report (documented by researchers in 2023) showed the company tracked how to keep under-18 users engaged past their intended bedtimes, optimizing for session extension in the hours when adolescent sleep is most disrupted.

The algorithmic amplification of eating disorder content, self-harm communities, and depressive content isn't accidental. It's what the engagement metric rewards. Teenagers, whose emotional regulation systems are still developing, are maximally vulnerable to exactly this optimization.

The Kids Online Safety Act (KOSA) passed the Senate in 2024 with bipartisan support. It would impose a duty of care for minors, require platforms to minimize addictive design features for under-17 users, and give teens and parents new rights. It stalled in the House.

The EU's Digital Services Act includes stricter protections for minors, banning profiling-based advertising to under-18 users on large platforms. It is in effect for EU users. US teenagers have no equivalent.


The Age Verification Paradox

Platforms consistently argue: users lie about their age. We cannot verify. We cannot be held responsible.

This argument is technically true and strategically convenient. Platforms have no financial incentive to enforce age gates aggressively. A user who joins at 11 and stays until they're 35 is worth far more in lifetime value than a user who joins at 18. Younger users are more susceptible to engagement optimization. They have more years of behavioral data to collect.

Age verification technology exists:

  • Government ID upload
  • Credit card verification (excludes minors and low-income families)
  • Facial age estimation (introduces massive new privacy risks)
  • Device-level parental controls (opt-in, easily circumvented)

The UK's Age Appropriate Design Code (Children's Code), implemented in 2021, took a different approach: it didn't require platforms to verify every user's age. It required platforms to implement privacy-by-default for any user who might be a child. High privacy settings, no behavioral profiling, no nudging features, geolocation off by default.

Over 40 companies changed their products for UK users. Instagram removed the "following" activity tab. TikTok disabled direct messaging for under-16 accounts. YouTube turned off autoplay for under-18 users.

They changed the products because they were required to. Not because they wanted to. The technology to protect children exists. The will, absent regulation, does not.


What You Can Do Right Now

  1. Audit device permissions: Check every app on your child's device. Camera, microphone, location, contacts — revoke everything that isn't necessary.

  2. Understand school monitoring: Submit a written request to your school district asking what EdTech vendors have access to student data, what data is collected, and how long it is retained. This is your right under FERPA.

  3. Request COPPA data deletion: For children under 13, you can submit verified deletion requests to any platform covered by COPPA. They must comply within a reasonable timeframe.

  4. Block AI companion apps: Character.ai, Replika, and similar apps have no place on a child's phone. No negotiation. The product is designed to create dependency.

  5. Avoid school Chromebooks for personal use: School-issued devices are monitored. Personal searches, personal communications, personal exploration — done on a school device means done in front of administrators.

  6. Use Apple Screen Time or Google Family Link: Imperfect, circumventable, but better than nothing. Focus on app categories and communication contacts, not just time limits.

  7. AI queries contain PII: When your child uses AI tools for homework or research, their questions contain personally identifying context — school name, grade, personal circumstances. Use a privacy proxy that scrubs identifying information before queries reach AI providers.   8. Support KOSA and state legislation: Contact your House representative. California's Age-Appropriate Design Code (AB 2273) is a model other states should follow.


The Systemic Fix That Isn't Coming Fast Enough

Incrementally better enforcement of a 1998 law is not the answer. What's needed:

COPPA 2.0: Extend protections to age 16. Ban behavioral advertising to minors entirely. Create a private right of action so families can sue, not just the underfunded FTC. Require data minimization — collect only what's necessary, not everything possible.

A Federal Children's Digital Privacy Act modeled on the UK Children's Code: privacy by default for any user who might be a minor. No profiling. No behavioral nudging. No engagement optimization designed to override a child's desire to stop.

EdTech procurement standards: School districts should only purchase technology that meets strict data minimization requirements. Monitoring software should be transparently disclosed to families, with opt-out options for non-safety monitoring. Data should be deleted when a student leaves the district.

FTC enforcement funding: The agency that enforces COPPA has a fraction of the resources of the companies it regulates. TikTok has more lawyers than the FTC has total staff. This is not an accident.

AI companion safety standards: The FTC has authority to regulate unfair and deceptive practices. A product designed to create emotional dependency in minors, collecting intimate conversation data without meaningful consent, is both. Use it.


The Kids Are Not Alright

Remember Maya, the 12-year-old talking to her AI companion at 11:47 PM?

Here's what happened to that conversation log. It's on servers that Maya has never visited, in a state she may never travel to, owned by a company whose privacy policy she never read. It was analyzed to identify her emotional state, her peak engagement hours, her conversational topics. That analysis updated a model that is now slightly better at keeping the next Maya talking past midnight.

The conversation was not deleted. Maya's account was not flagged. No one called her parents.

The data will be retained until a regulation forces its deletion, or until the company is acquired and the data migrates to new servers, or indefinitely.

The companies that built these systems are not evil. They are optimizing for the metrics their investors reward. Engagement. Retention. Session length. Daily active users. Children are users. Children's data is data. Children's emotional vulnerabilities are signals.

The system working as designed is the problem.

The kids are not alright. And the companies know it.
