You submitted a resume. You completed a video interview. You took a personality assessment. You didn't get the job. What happened to the behavioral profile the AI built on you during that process?
The short answer: nobody's telling you.
AI hiring tools — systems that screen resumes, score video interviews, analyze speech patterns, detect emotional states, and rank candidates — are deployed by over 55% of Fortune 500 companies. The companies that build these tools collect data at a depth that traditional hiring never approached: not just qualifications and work history, but micro-expressions, vocal tone, response timing, eye movement, and personality trait inferences.
This data is collected at a moment of maximum vulnerability. You need a job. You will submit to the assessment. The behavioral profile generated persists long after the hiring decision.
What AI Hiring Tools Actually Collect
Resume Screening
Resume screening algorithms analyze text for keywords, formatting, employment gaps, educational pedigree, and hundreds of other signals. The inputs are relatively transparent. The weights are proprietary.
IBM's Watson Recruitment system, Workday's Recruiting AI, and similar tools embed pattern-matching models trained on historical hiring decisions. If a company's historical hires were predominantly from specific universities, lived in specific zip codes, or used specific language patterns, the model learns to prefer those characteristics — including characteristics that correlate with race, gender, and age without explicitly encoding them.
The EEOC has issued guidance that AI hiring tools must comply with Title VII, the Age Discrimination in Employment Act, and the Americans with Disabilities Act. Disparate impact — where a neutral-seeming criterion produces discriminatory outcomes — is legally actionable regardless of whether the discrimination was intentional. But enforcement requires auditing the model's outcomes, and most employers do not conduct demographic impact audits of their AI hiring tools.
Video Interview Analysis
HireVue, Modern Hire, and Pymetrics are among the largest AI video interview platforms. Their systems analyze:
- Facial expressions: micro-expressions, smile frequency, eye contact, blink rate
- Vocal features: tone, pitch, speaking pace, filler word frequency, vocal energy
- Language patterns: response structure, vocabulary complexity, keyword presence
- Behavioral signals: response timing, body language, gesture frequency
HireVue's documentation (before they walked back specific claims under pressure from the Electronic Privacy Information Center) described analyzing "facial movements" and "tone of voice" to predict "competencies." EPIC filed an FTC complaint in 2019 documenting HireVue's use of facial analysis, lack of transparency, and inability for candidates to access or challenge their scores.
In 2021, HireVue announced it was removing facial expression analysis from its system following the EPIC complaint, AI Now Institute criticism, and Illinois's Artificial Intelligence Video Interview Act (AIVIA). The vocal and language analysis components remained.
Psychometric Game Assessments
Pymetrics uses neuroscience-based games — balloon pumping tasks, memory games, attention tasks — to generate trait profiles: risk tolerance, attention, memory, cognitive speed, emotional sensitivity. These profiles are mapped against "benchmark" models built from current high performers at client companies.
The privacy concern: you are generating a behavioral and cognitive profile during a job application. That profile — your risk tolerance, memory performance, emotional reactivity — is retained by Pymetrics. The company's privacy policy describes data retention and potential reuse across its client network.
If Pymetrics shares (with candidate consent, buried in assessment terms) your profile across its employer network, you may be pre-screened and rejected at companies you haven't applied to, based on a profile generated during a previous application you didn't get.
The Illinois Artificial Intelligence Video Interview Act
Illinois's AIVIA (effective 2020) is the most comprehensive AI hiring transparency law in the United States. It requires:
- Employers notify candidates that AI is used to analyze their interview
- Explain what factors the AI analyzes
- Obtain consent before the interview
- Prohibit sharing video recordings except for limited purposes
- Delete recordings within 30 days of request
Compliance is uneven. A 2022 audit of AIVIA compliance found that 40% of Illinois employers using HireVue or similar tools were not providing required disclosures. The Illinois Department of Human Rights, which enforces AIVIA, had issued zero enforcement actions through 2023.
No federal equivalent of AIVIA exists. Outside of Illinois (and Maryland, which has a weaker biometric notice requirement), candidates in AI video interviews have no statutory right to know what is being analyzed.
The Data Retention Problem
The behavioral profiles generated during AI hiring processes persist. The relevant questions — where, how long, for what purposes — are answered, if at all, in privacy policies that candidates do not read and cannot negotiate.
HireVue retains interview recordings per employer instructions. If the employer retains indefinitely (permitted under HireVue's terms), your video, audio, and generated scores persist in HireVue's infrastructure indefinitely. HireVue's 2023 privacy policy allows retention for "as long as necessary for our business purposes."
Pymetrics retains game performance data for 2 years after your last interaction. With consent (which the assessment flow elicits), profiles can be shared with other employers in the Pymetrics network — creating a persistent behavioral profile that follows you across multiple job applications.
Workday Recruiting retains candidate data per each employer client's configuration. Workday's default is 3 years. Employers may configure longer retention. You have no way to know how long any given employer has configured retention without asking, and no guarantee they will answer accurately.
Algorithmic Discrimination: Documented Cases
AI hiring tool discrimination is not theoretical.
Amazon's recruiting AI (2018): Amazon built an ML resume screening tool trained on 10 years of historical hiring decisions. Because historical technical hires were predominantly male, the model learned to penalize resumes that included the word "women's" (as in "women's chess club") and downgraded graduates of all-women's colleges. Amazon scrapped the tool. The case is now a standard example in AI ethics literature.
iTutorGroup age discrimination (2022): The EEOC filed a lawsuit against iTutorGroup alleging that its AI hiring software was configured to automatically reject applications from women over 55 and men over 60. The case settled for $365,000 — the first EEOC action explicitly targeting AI hiring discrimination. The configuration was deliberate, but the more concerning scenario is unintentional disparate impact from model training on biased historical data.
Workday class action (2023): Derek Mobley filed a class action suit against Workday alleging that Workday's AI hiring tools systematically rejected him and other Black, disabled, and over-40 applicants through discriminatory algorithmic screening. The case survived a motion to dismiss in 2024 — a federal judge ruled that Workday could be liable as an employment agency under Title VII for operating discriminatory screening algorithms even though Workday is not the employer. This decision is significant: it potentially extends civil rights liability to AI tool vendors, not just the employers who deploy them.
The Transparency Vacuum
Candidates subject to AI hiring processes cannot:
- Request their AI-generated score
- Understand what factors drove the score
- Challenge an incorrect or discriminatory assessment
- Know how long their profile is retained
- Know whether their profile is shared with other employers
The EEOC's 2023 guidance on AI and disability discrimination recommends that employers provide "reasonable accommodations" for AI assessments — for example, allowing a candidate with a facial nerve condition to complete an alternative to video analysis. But the guidance is non-binding, and compliance is voluntary.
New York City's Local Law 144 (effective 2023) requires employers using automated employment decision tools to conduct annual bias audits and disclose AI use to candidates. NYC is the only major US jurisdiction with this requirement. The audit results are self-reported and not verified.
What This Means for Candidates
If you are applying for jobs in 2026:
Assume AI screening — the majority of large employers use resume screening algorithms. Keyword optimization matters. Unusual formatting (tables, graphics) breaks parsers.
Know your Illinois rights — if you're in Illinois and an employer uses AI video analysis, they must disclose it and get consent. Absence of this disclosure is a compliance violation.
Request data deletion — under CCPA (California) and GDPR (EU), you have the right to request deletion of your personal data held by hiring platform vendors. Submit deletion requests after application processes conclude.
Read the assessment privacy policy before consenting — assessment terms often include consent to share your profile with other employers in the vendor's network. This is opt-out, not opt-in, in most implementations.
The profile persists — your Pymetrics game scores, your HireVue interview analysis, your psychometric assessment results may follow you to your next application, and the one after that. There is no credit report equivalent for AI hiring profiles — no right to access, dispute, or correct.
