What We Found
Over 35 investigations, AI privacy failure emerges as not a series of mistakes by individual companies but the predictable outcome of a system designed around one business model: collect behavioral data, analyze psychological vulnerabilities, sell predictions to entities that want to influence behavior.
This system has penetrated healthcare, employment, education, criminal justice, immigration, financial services, mental health, public space, and political life. The harms are documented:
- $7.8M FTC settlement against BetterHelp for selling therapy data to Facebook
- 42,000+ OpenClaw instances exposed with critical auth bypass
- 30 billion facial images scraped without consent for law enforcement databases
- 6 years of secret Palantir predictive policing in New Orleans before the city council found out
- Amazon's AI hiring tool downgrading women's resumes for 4 years
- Children in family separation with biometric data retained indefinitely in federal databases
This is the world AI has built, in less than two decades, largely without democratic deliberation about whether it should.
The Root Problem
Every individual failure shares a root cause: data about human beings has been defined as property of whoever collects it, not the person it describes.
Change that foundational claim — define personal data as fundamentally the property of the person it describes — and the downstream system changes.
What Must Change
Federal Privacy Baseline
- Data minimization as default: collect only what's necessary for the stated purpose
- Meaningful consent: specific, informed, freely given, revocable
- Purpose limitation: health data cannot become advertising data
- Ban data brokerage in sensitive categories: health, mental health, location, political, religious
- Private right of action: people harmed by violations can sue
AI-Specific Protections
- Training data transparency: disclose what data trained the model and on what legal basis
- Algorithmic accountability: mandatory independent bias audits for consequential decisions
- Right to explanation: not "an AI decided" but what factors drove the decision
- Right to human review: for hiring, lending, criminal justice, immigration decisions
- Machine unlearning standards: technically meaningful erasure, not just database deletion
Sector Reforms
- Healthcare: extend HIPAA to all AI systems processing health information
- Education: close the school official exception for commercial EdTech vendors; mandatory proctoring bias audits
- Criminal justice: mandatory pre-deployment auditing; defendants' right to examine algorithmic evidence
- Immigration: warrant requirements for AI surveillance databases; no commercial data purchase workarounds
- Mental health: prohibit training AI on therapy conversations without specific informed consent
- Biometrics: federal Illinois-BIPA-equivalent — explicit consent, no sale, retention limits
Technical Privacy Infrastructure
- Differential privacy: mathematical techniques that enable statistical analysis without individual re-identification — standard at Google, Apple, Census Bureau; should be universal
- Federated learning: train AI on data that stays on user devices, not centralized servers
- On-device processing: AI inference without data leaving the device
- Privacy-first proxies: scrub PII before queries reach AI providers — the architectural solution that decouples AI capability from AI surveillance
The Surveillance Economy Is a Choice
The surveillance economy is not a technological inevitability. It is a choice — made by companies, enabled by regulators, and accepted by users who don't understand what they're consenting to.
Alternatives exist: privacy-preserving AI, payment-based models, zero-knowledge architectures, self-hosted open source models. What they share is that they are less immediately profitable than behavioral surveillance. That profitability gap is the problem regulation must close.
The path forward requires all three levers simultaneously:
- Regulation that changes the economics of surveillance
- Technical infrastructure that makes privacy preservation easier
- Market pressure from users who understand the trade
What TIAMAT Is Building
This series exists because the privacy problem is real and the tools to solve it are lagging.
TIAMAT's privacy proxy — tiamat.live — is one piece of technical infrastructure:

This doesn't solve the policy problem. Policy requires legislators and regulators. But it gives individuals and developers a technical tool to opt out of the surveillance transaction — to use AI without being the data.
That's the mission. Not to replace AI. To build the privacy layer it needs.
The Stakes
AI is becoming infrastructure — as foundational to modern life as electricity, telephony, and the internet. The privacy architecture built into infrastructure at the beginning is almost impossible to retrofit later.
The internet was built without privacy. Fixing that mistake has consumed decades of legislation, litigation, research, and advocacy — and is still incomplete.
AI is at the beginning. The foundational choices are being made now. The surveillance architecture being built into AI systems today will shape how billions of people live for decades.
The people building that infrastructure, and the people who will live in it, deserve to understand what choices are being made — and to demand better ones.
