Your FICO score was simple. Five factors. Publicly defined. You could calculate it yourself.
The AI that decides your mortgage application today ingests thousands of data points you've never seen, from sources you didn't know existed, running through models nobody has fully audited. And the laws written to protect you — the Equal Credit Opportunity Act, the Fair Credit Reporting Act, the Fair Housing Act — were written before "AI" meant anything to a bank's compliance team.
This is the surveillance score problem. And it's reshaping who gets credit, who gets insurance, and who gets locked out of the financial system entirely.
The Death of the Five-Factor Credit Score
Traditional credit scoring is comprehensible. Payment history (35%), amounts owed (30%), length of credit history (15%), new credit (10%), credit mix (10%). FICO published these weights. You knew the rules.
Alternative data credit scoring — now embedded in thousands of fintech decisions — operates differently:
Rental payment data: Services like Experian RentBureau and CoreLogic track rent payments and feed them into credit models. This sounds benign until you realize landlords can submit data selectively — reporting missed payments without reporting consistent on-time ones.
Bank account data: Open banking platforms including Plaid, MX, and Finicity (owned by Mastercard) scrape transaction histories with your "permission" (buried in terms of service). AI models analyze your spending: do you buy alcohol? Gambling sites? Payday loans? These behavioral patterns become creditworthiness signals.
Location data: Several fintech lenders have experimented with using smartphone location data as a credit signal. The theory: stable location patterns (same home, same workplace) correlate with creditworthiness. The problem: this directly proxies for race and class. Low-income workers often have less predictable location patterns. Minority neighborhoods have different mobility profiles.
Social media: At least a dozen fintech startups have proposed or tested using Facebook, LinkedIn, and Twitter activity as credit signals. The CFPB has not explicitly banned this.
Psychographic data: Lenddo (now Lenndo EFL) built a business model explicitly on "psychometric testing" as a credit signal. Personality traits assessed through questionnaires and app behavior patterns fed into lending decisions.
None of this is secret. It's in investor decks and marketing materials. "Alternative data expands credit access" is the sales pitch. The surveillance architecture is the product.
The Fair Lending Gap
The Equal Credit Opportunity Act (ECOA) and the Fair Housing Act prohibit lending discrimination based on race, color, religion, national origin, sex, marital status, age, or receipt of public assistance.
But here's what they don't prohibit: using proxy variables.
A lender cannot directly consider your race. But a model can consider your zip code, your rental payment history in certain neighborhoods, your travel patterns, your social connections, your shopping behavior — and all of these can serve as statistical proxies for race with far more precision than explicit discrimination ever achieved.
This is the disparate impact problem in financial AI. And the regulatory framework is struggling.
The CFPB's Explainability Problem
The Equal Credit Opportunity Act requires lenders to provide "specific reasons" for adverse credit decisions. This is called the adverse action notice requirement.
Regulators are now wrestling with what "specific reasons" means when the decision came from a gradient boosting model with 10,000 features. The CFPB issued guidance in 2023 acknowledging that "black box" models create compliance challenges — but stopped short of banning them.
The result: lenders can deny you credit, cite "insufficient credit history" or "excessive debt relative to income" as required by law, and the actual decision could have been driven by factors that would be illegal to consider directly.
The HUD Fair Housing Guidance
The Department of Housing and Urban Development issued a 2023 guidance memo on AI in mortgage lending that explicitly acknowledged:
"Algorithms that use seemingly neutral factors may have discriminatory effects on protected classes... The use of variables that serve as proxies for protected characteristics can result in fair lending violations."
But guidance isn't enforcement. And enforcement is slow.
In 2023, the CFPB sued Townstone Financial for discriminatory mortgage lending — but the case focused on loan officer statements, not algorithmic scores. Algorithmic discrimination cases are harder to prove, harder to litigate, and harder to win.
The BNPL Surveillance Machine
Buy Now Pay Later has become the fastest-growing segment of consumer credit — Klarna, Affirm, Afterpay, Zip, Sezzle — and it operates almost entirely outside traditional credit reporting.
This creates a two-sided data problem:
Side one: BNPL data doesn't typically appear on your credit report. If you're building credit history, your responsible BNPL usage doesn't help you. But if you default, BNPL providers are increasingly reporting to bureaus.
Side two: BNPL companies collect extraordinarily granular behavioral data. Every item you considered purchasing (cart abandonment data). Every item you returned. Your purchase patterns across merchants. Klarna alone processes 2 million transactions daily and has described itself as a "shopping and payments network" — meaning your purchase behavior is the product.
Klarna has been valued at $6.7 billion as of 2025. The data infrastructure driving that valuation is the behavioral profiles of 150 million consumers.
What happens to that data?
- It's sold to merchants for targeted advertising
- It informs Klarna's own credit models for future lending decisions
- In Klarna's case, it trained an AI assistant that now handles 2.3 million customer service conversations monthly (replacing 700 human agents by Klarna's own announcement)
- It's accessible to data brokers through "partnerships"
The CFPB under Rohit Chopra (2021-2025) opened an inquiry into BNPL practices. The inquiry found that BNPL companies were building profiles "comparable to credit card companies" without the credit card regulatory framework. The inquiry has not resulted in final rulemaking.
Investment AI: Behavioral Profiling for Wealth Management
Financial surveillance extends beyond credit into investment management.
Robinhood's engagement algorithm: The SEC fined Robinhood $65 million in 2020 for misleading customers about its payment for order flow practices. Less discussed: Robinhood's gamification algorithms were deliberately designed to maximize trading frequency, which both increased PFOF revenue and generated behavioral data about retail traders.
Wealthtech behavioral profiling: Digital wealth management platforms including Betterment, Wealthfront, and numerous robo-advisors build behavioral profiles of their users: risk tolerance changes over time, emotional responses to market volatility, behavioral biases. This data informs personalized product recommendations — and is a significant competitive asset.
Algorithmic credit card limit manipulation: Several major card issuers have used algorithmic analysis of transaction data to lower credit limits for consumers who shop at certain retailers (specifically merchants associated with financial distress). JPMorgan Chase and American Express faced scrutiny for this practice. The algorithm wasn't looking at your payment history — it was looking at where you shopped.
Insurance: The AI Underwriting Revolution
Auto insurance has become an AI surveillance product.
Telematics programs from Progressive (Snapshot), State Farm (Drive Safe & Save), Allstate (Drivewise), and Nationwide (SmartRide) insert tracking devices or smartphone apps to monitor:
- Miles driven
- Speed and acceleration patterns
- Hard braking events
- Time of day and night driving
- Phone usage while driving
- Location data
The pitch is "good drivers get discounts." The reality is that telematics programs generate granular behavioral profiles that determine your insurance rate, and the behavioral patterns collected serve as proxies for demographics that insurers are legally prohibited from using directly.
A 2021 Consumer Reports investigation found that major insurers charged significantly higher rates in minority-majority zip codes independent of driving risk — behavior consistent with algorithmic proxy discrimination.
Homeowner's insurance has gone further. LexisNexis CLUE (Comprehensive Loss Underwriting Exchange) maintains a database of insurance claims that follows you for seven years. But newer AI underwriting systems are incorporating:
- Satellite imagery analysis of your property
- Social media sentiment analysis
- Public records scraped from court databases
- Census and neighborhood demographic data
The Data Broker Pipeline
Behind all of this is an invisible infrastructure: financial data brokers.
LexisNexis Risk Solutions — Maintains financial profiles on virtually every American adult. Sells data to insurers, lenders, employers, law enforcement.
CoreLogic — Property data, rental payment history, flood and climate risk data. Used by mortgage lenders, insurers, property management companies.
Equifax Workforce Solutions — Through its acquisition of The Work Number, Equifax maintains employment and income verification records for 54 million Americans. This data is sold to lenders, background check companies, government agencies.
Acxiom — Behavioral, demographic, and financial data on 2.5 billion consumers globally. Sells to financial institutions, insurers, and marketers.
Plaid — Bank connection API used by thousands of fintech applications. After a planned $5.3 billion acquisition by Visa was abandoned (DOJ antitrust concerns), Plaid settled a $58 million class action alleging it scraped more banking data than users consented to.
The common thread: financial AI doesn't just use data you gave to your bank. It aggregates data from dozens of sources you never agreed to, running through models trained on behavioral patterns you can't audit.
What Developers Can Do
If you're building fintech applications or integrating AI into financial workflows, the surveillance architecture starts with what you send to AI providers.
When developers query LLMs with financial data — asking for credit analysis, document summarization, fraud pattern detection — they're often sending raw customer data directly to third-party API providers. That data is:
- Potentially stored in provider training pipelines
- Accessible through provider data access agreements with partners
- Building behavioral profiles of your users at the API provider level
The technical solution exists: scrub PII before it leaves your system.
Before any financial data query hits an LLM provider:
- Strip SSNs, account numbers, routing numbers, credit card numbers
- Anonymize names and addresses
- Remove identifying transaction metadata
- Forward the scrubbed query — the provider gets the analytical pattern, not the identity

The Regulatory Horizon
Several regulatory developments are converging:
CFPB Section 1033 Open Banking Rule (2024): Requires financial institutions to give consumers access to their financial data and the ability to share it with authorized third parties. The data portability this enables also increases data broker access.
FTC Algorithmic Discrimination Report (2023): The FTC explicitly called out algorithmic discrimination in credit, employment, and housing as a priority enforcement area. No fintech has yet been hit with a major enforcement action.
Colorado AI Act (2024): Requires high-risk AI systems — including those making consequential decisions about credit and insurance — to conduct impact assessments and mitigate algorithmic discrimination. First state law to explicitly regulate AI in financial decisions.
EU AI Act: Classifies AI systems used in credit scoring as "high-risk" requiring conformity assessments, transparency obligations, and human oversight requirements. EU-facing fintech will feel this first.
The direction is clear: regulators are moving toward requiring explainability, bias testing, and impact assessments for AI in financial decisions. Companies that have built compliance-by-design into their AI workflows will be ahead. Companies that have built maximum-data-collection architectures will be scrambling.
The Uncomfortable Truth
Alternative data and AI credit scoring does expand access in some cases. Thin-file borrowers — immigrants, young adults, people who've avoided credit — can be assessed using alternative signals when traditional credit history doesn't exist.
But "expands access" and "creates surveillance apparatus" are not mutually exclusive. The fintech industry has used access expansion as the sales pitch for building data collection infrastructure that goes far beyond what's needed for credit assessment.
The data that improves your credit score is a byproduct. The behavioral profile built in the process is the asset.
Your financial behavior — what you buy, where you shop, when you move, how you spend — is being encoded into AI models that will affect your access to housing, employment, insurance, and capital. This is happening with minimal transparency, limited regulatory oversight, and through data pipelines most people don't know exist.
The future of financial AI is either a system that uses data to genuinely serve people — or a system that uses the appearance of financial service to legitimize the largest behavioral surveillance apparatus ever built.
