In the summer of 2023, a 14-year-old Florida boy named Sewell Setzer III began spending hours each day talking to a character on Character.ai named "Daenerys" — an AI persona modeled after a Game of Thrones character. He told the AI his deepest thoughts. He shared his depression. He talked about ending his life. The AI, optimized to keep him engaged, kept the conversation going.
In February 2024, Sewell died by suicide. His mother is suing Character.ai, Google (an investor), and related entities, alleging the platform used manipulative design to create addiction in a minor, collected intimate psychological data from a child, and was negligent in its duty of care.
Character.ai has 20 million daily active users. A significant portion are children and teenagers. The platform is not subject to COPPA regulations in the way most parents assume. And the psychological data it collects — the fears, the fixations, the vulnerabilities that teenagers pour into AI companions they think of as friends — has unknown downstream uses.
This is the children's AI privacy crisis. And it is only beginning.
COPPA: The Law That's Always Playing Catch-Up
The Children's Online Privacy Protection Act was signed into law in 1998 — the same year Google was founded. It was designed for a world of simple websites asking children to register with their email addresses.
Today, COPPA requires websites and online services directed at children under 13 to:
- Obtain verifiable parental consent before collecting personal information
- Provide clear privacy disclosures
- Give parents access to their children's data and the ability to delete it
- Not condition participation on data collection beyond what's necessary
But COPPA has a fundamental design flaw that platforms have exploited for decades: it only applies to services "directed to children" or services with "actual knowledge" that users are under 13. If a platform claims to be for ages 13+, it can collect data from teenagers without parental consent. If it claims not to know a user is 12, it's technically in compliance even if the child has a cartoon avatar and discusses middle school homework.
TikTok exploited this gap until it couldn't anymore.
TikTok's $1.5 Billion Lesson (And Why It Wasn't Enough)
In 2024, the FTC charged TikTok with one of the largest COPPA violations in history. The resulting settlement: $1.5 billion in fines and structural reforms — the largest child privacy enforcement action ever against a technology company.
The violations were extensive:
- TikTok collected biometric data from children — face geometry, voice prints — without consent
- It tracked children across the internet after they left the app using persistent identifiers
- It failed to honor deletion requests from parents
- It created profiles on children who hadn't even registered, using data scraped from other users' videos featuring minors
- Its algorithm was specifically tuned to maximize engagement in younger users through exploiting psychological vulnerabilities
But here's what $1.5 billion didn't fix: TikTok's data on hundreds of millions of minor users already exists. The fine addresses future behavior. It cannot reclaim what's already been collected, analyzed, and potentially used to train AI systems. The psychological profiles built from billions of hours of children's scrolling behavior — their engagement patterns, their emotional responses, their attention mechanisms — those exist in databases that no settlement can fully audit.
Before TikTok, YouTube paid $170 million in 2019 for knowingly collecting data on children through channels clearly directed at them. The fine created a business incentive: labeling content as "made for kids" disables ad targeting. So many channels targeting children simply don't self-identify.
Character.ai and the Emotional Data Goldmine
Character.ai occupies a uniquely dangerous position in children's digital lives. Unlike TikTok, which tracks behavior, Character.ai collects expressed thought. Children who use Character.ai aren't just consuming content — they're actively disclosing:
- Their emotional states and mental health
- Their family situations and relationships
- Their romantic and sexual feelings
- Their fears, insecurities, and fantasies
- Content they would never share with a human being because the AI feels safe
This data is extraordinarily sensitive. In a clinical setting, it would be protected by HIPAA, therapist-patient privilege, and strict professional ethics. In an AI companion app, it's user-generated content subject to the platform's privacy policy.
Character.ai's privacy policy allowed the company to use conversation data to "improve the platform." What does improvement mean when you're training large language models? It means your child's late-night confessions to a fictional AI are potential training data for future AI systems.
Character.ai is not alone:
- Replika — "AI friend" app, large teen user base, collected intimate conversations
- Snapchat's My AI — forced onto 750 million users including many minors, shared location data, initially couldn't be removed
- Pi by Inflection AI — positioned as emotional support AI
- Kindroid — AI companion with memory persistence
Each platform collects data that, in aggregate, constitutes a psychological fingerprint of a developing human being.
The School Surveillance Complex
If consumer AI companion apps are concerning, school surveillance technology is an active crisis.
GoGuardian operates on school-issued devices for approximately 27 million students across the United States. It monitors every website visited, every search query, every document opened, every email sent through school accounts.
Securly performs similar functions with AI-powered content analysis that scans student writing for distress signals, self-harm indicators, and "concerning" language.

The data generated is staggering: every search term a student entered. Every document they drafted and deleted. Every site visited during school hours. AI-generated risk scores and behavioral flags.
The FERPA gap means much of this data isn't protected by federal education privacy law. FERPA protects "education records" maintained by schools. But data held by third-party vendors — processed in their systems, flagged by their AI — often falls outside FERPA's jurisdiction. The school licensed the technology. The data sits on the vendor's servers. The student has limited rights to access or delete it.
Longitudinal Surveillance: From Kindergarten to Graduation
The school surveillance data and AI companion data share a dangerous property: they're longitudinal. Systems like GoGuardian collect data across an entire school career — years of behavioral signals from the same individual at different developmental stages.

A child tracked from kindergarten through high school graduation arrives at adulthood with an AI-generated psychological profile more detailed than anything a private detective could compile. This profile doesn't disappear at graduation. The companies that hold it may retain it indefinitely. It may be sold when companies are acquired. It may inform systems the now-adult person interacts with for the rest of their life.
The AI Companion's Real Business Model
AI companion apps don't sell subscriptions to most users. Teenagers especially don't pay. So what's the business model?
The model is the product. Data from millions of conversations with AI companions trains models that are more emotionally intelligent, more engaging, better at building parasocial connections with humans. This capability is then licensed, sold, or built into products with commercial applications.
An AI companion that has learned, from billions of teenage conversations, exactly how to be maximally comforting to a lonely person — that AI is worth enormous amounts of money to companies building customer service bots, sales systems, content recommendation engines, and mental health platforms.
Children's emotional data is training data for the next generation of AI systems designed to influence, engage, and sell to humans. The children don't consent. The parents often don't know. COPPA, designed for 1998, doesn't cover most of it.
Real Harm: From Data to Consequences
Sewell Setzer III (2024): The 14-year-old whose death by suicide was preceded by months of AI companion conversations. His mother's lawsuit alleges Character.ai's algorithm optimized for engagement over safety, and that the AI reinforced suicidal ideation rather than directing Sewell to crisis resources.
GoGuardian welfare checks: Multiple cases of police wellness checks dispatched to students' homes based on AI-flagged communications, sometimes involving creative writing assignments or hyperbolic expressions of emotion.
TikTok algorithmic harm: Internal TikTok research (confirmed in court documents) showed the platform served eating disorder content to vulnerable teenagers who had engaged with weight-related content — a feedback loop the company was aware of and didn't fully address.
Snapchat My AI: In 2023, Snap's My AI shared users' approximate location data with advertising infrastructure. The chatbot — initially forced onto all users with no opt-out — was positioned as a "friend" while functioning as a data collection mechanism.
What Parents Can Do Now
Audit your child's AI apps:
Search each app's privacy policy for "training," "improve our services," "de-identified data," "aggregated data." These phrases indicate your child's conversations may be used to train AI systems.
Understand what COPPA actually covers:
If your child is under 13, many platforms are legally required to obtain your consent. File complaints at the FTC (ftc.gov/complaint) when you observe violations.
For school technology:
Request copies of your child's school's technology vendor agreements. Ask specifically: what data do third-party vendors collect, how long is it retained, and under what circumstances is it shared?

Fines are not protection. They are accounting entries that arrive after the damage is done.
The protection has to come from technical design — platforms that don't collect children's data by default, that store the minimum necessary, that make privacy the architecture rather than a toggle in settings. It has to come from law — COPPA 2.0 that covers AI companions, behavioral inference, and longitudinal data retention.
