California vs. Surveillance Capitalism: How CCPA Became the De Facto Privacy Law of the United States

In June 2018, a retired real estate developer named Alastair Mactaggart spent $3 million of his own money to put a ballot initiative before California voters. The initiative was simple: Californians should have the right to know what data companies collect about them, the right to delete it, and the right to stop its sale. Tech companies panicked. They spent $45 million lobbying against it. They failed. CCPA passed.

That moment — a single wealthy citizen outmaneuvering the entire US tech lobby — tells you everything about how American privacy law gets made. Not through Congress. Not through comprehensive federal legislation. Through California, acting unilaterally, setting a standard that the rest of the country is forced to follow.

This is the story of how CCPA became the closest thing America has to a privacy constitution — and why it's still not enough.


The California Difference

The California Consumer Privacy Act was signed into law on June 28, 2018, and took effect January 1, 2020. It was the first comprehensive consumer privacy law in United States history.

Let that sink in. The country that invented the internet, that hosts every major tech company on earth, that produces the majority of the world's AI systems — had no comprehensive privacy law until 2020, and still has no federal law at all.

CCPA passed not because Congress acted, but because California's unique ballot initiative mechanism allows citizens to bypass a paralyzed legislature. Mactaggart's initial initiative was stronger than what eventually passed — the legislature negotiated it down in exchange for him withdrawing the ballot measure. The result was CCPA: meaningful, but already compromised at birth.

Then, in November 2020, California went further. Proposition 24 — the California Privacy Rights Act (CPRA) — passed with 56% of the vote. It strengthened CCPA significantly and created something unprecedented in American privacy enforcement: the California Privacy Protection Agency (CPPA), a dedicated state agency with a mandate to enforce privacy law and write new rules. CPRA took full effect January 1, 2023.

For the first time in US history, there was an agency whose entire purpose was protecting consumer privacy. In Europe, that's called a Data Protection Authority. America had nothing like it — until California built one.


What CCPA Actually Does

CCPA applies to for-profit businesses that do business in California AND meet at least one of these thresholds:

  • Annual gross revenue over $25 million
  • Buy, sell, receive, or share personal information of 100,000+ consumers or households annually
  • Derive 50% or more of annual revenue from selling consumers' personal information

That scope is enormous. And critically: it applies to California residents, wherever their data is processed. You don't have to do business in California — you have to have California customers.

Under CCPA/CPRA, California consumers have these rights:

Right to Know: What personal information is collected, why, and with whom it's shared.

Right to Delete: Request deletion of personal information (with significant exceptions for completing transactions, security, legal obligations, and more).

Right to Opt-Out of Sale/Sharing: Stop companies from selling or sharing your data for cross-context behavioral advertising.

Right to Non-Discrimination: Companies cannot deny service or charge more because you exercised your privacy rights.

Right to Correct (CPRA addition): Request correction of inaccurate personal information.

Right to Limit Sensitive Data Use (CPRA addition): Restrict how sensitive information — health, race, religion, precise geolocation, sexual orientation — is used.

The penalty structure matters too. CPPA can impose:

  • $2,500 per unintentional violation
  • $7,500 per intentional violation
  • Private right of action for data breaches: $100–$750 per consumer per incident

Those numbers sound small. Against a company processing 50 million records, they add up fast — theoretically.


The Fines That Actually Happened

Enforcement started slowly. The AG's office had 30-day cure periods, limited staff, and limited budget. But the fines that did land were instructive.

Sephora — $1.2 million (August 2022)

The first major CCPA enforcement action. California Attorney General Rob Bonta found that Sephora had been selling customer data to analytics companies — purchase history, browsing behavior, location data — without adequate disclosure. Worse: Sephora was ignoring Global Privacy Control (GPC) signals, the browser-level opt-out mechanism that CCPA requires businesses to honor.

Bonta was explicit: "Consumers who tried to invoke their right to opt-out of the sale of their personal information were ignored."

Sephora paid $1.2 million and agreed to sweeping compliance changes. More importantly, it put every e-commerce company on notice: GPC signals are legally enforceable opt-outs.

DoorDash — $375,000 (February 2024)

DoorDash shared customer and delivery driver personal information — names, contact info, order history — with a marketing co-op without adequately disclosing the practice or giving consumers a meaningful opt-out. A reminder that it's not just Big Tech in the crosshairs: gig economy platforms are data companies too.

Tillamook County Creamery Association — $100,000 (2023)

A mid-sized dairy cooperative. The fine was small, but the signal was clear: CCPA applies to companies far beyond Silicon Valley. Any business collecting enough California customer data is in scope.

Honda — Investigation and Compliance Order (2023)

Honda's connected vehicle platform was not properly honoring opt-out requests. The company was required to restructure its data practices and implement mechanisms to respect consumer choices — demonstrating that even vehicle data is in CCPA's scope.

What's notable about these cases: they're the tip of the iceberg. CPPA's enforcement budget is roughly $15 million annually. Acxiom alone generates $1.5 billion per year from data. The asymmetry between enforcement capacity and industry scale is staggering.


The Opt-Out Signal Problem

One of CCPA's most important — and most ignored — mechanisms is the Global Privacy Control.

GPC is a browser-level signal, like a digital Do Not Call registry. Install the GPC browser extension (or use a browser like Brave that sends it automatically), and every website you visit receives a machine-readable signal: "Do not sell or share my personal data."

CCPA and CPRA require businesses to honor this signal. It's not optional. You don't have to click through a cookie banner. The signal is legally binding.

And yet: the vast majority of websites ignore it. The Sephora case was the first time an AG enforced GPC compliance. CPPA has signaled that GPC enforcement will be a priority — but the gap between the law on paper and the web in practice remains enormous.

Dark patterns make this worse. Cookie consent banners are often deliberately designed to make opting out harder than opting in. Twelve clicks to reject all vs. one click to accept all. Buttons in gray vs. bright colors. Pop-ups that obscure content until you comply. The EU's GDPR regulators have fined multiple companies specifically for dark pattern manipulation. US enforcement on dark patterns is still developing.

CPPA opened formal investigations in 2024 into major retail, streaming, and HR platforms specifically targeting dark patterns and GPC non-compliance. The results of those investigations will define how much teeth CCPA actually has.


The "Sale" Loophole — and How CPRA Closed It

Original CCPA defined "selling" data narrowly enough that companies found easy workarounds. Sharing data with a third-party analytics platform under a "service provider" agreement? Not a sale. Passing behavioral data to an advertising network for targeting? Legal, with the right contractual language.

The service provider carve-out was enormous: share data with Google Analytics, Facebook Pixel, or any ad tech platform as long as there's a Data Processing Agreement — not a sale. The entire behavioral advertising ecosystem operated in this space.

CPRA (2023) closed most of this. It added "sharing" to the opt-out right — specifically covering "cross-context behavioral advertising." The intent: even if you call it sharing instead of selling, if the purpose is behavioral advertising, consumers can opt out.

Data brokers are still largely operating. Acxiom, LexisNexis, Experian, CoreLogic — companies that have never directly touched most consumers but hold thousands of data points on each of them. CCPA gives you the right to request your data from these brokers and delete it. In practice, the opt-out process is bureaucratically difficult by design. Some brokers require you to submit a form with your own personal information to opt out of their database — creating a Kafkaesque privacy violation as the price of privacy protection.


The De Facto National Standard

Here's why California's law matters everywhere, not just in California: data doesn't know state lines.

Companies collecting data on users can't always determine which users are California residents. Many have found it easier to apply CCPA-level protections to all US users rather than build state-by-state segmentation. The result: CCPA has become a de facto national baseline for companies large enough to care about compliance.

Other states noticed. As of 2024, 13 states have enacted comprehensive privacy laws:

  • Virginia (VCDPA, 2023)
  • Colorado (CPA, 2023)
  • Connecticut (CTDPA, 2023)
  • Texas (TDPSA, 2024)
  • Oregon, Montana, Tennessee, Indiana, Iowa, Delaware, New Hampshire, New Jersey, Nebraska

Most of these laws are modeled partly on CCPA, but weaker: no private right of action, narrower definitions of sensitive data, more generous exemptions. California remains the strongest state law by most measures.

And federal law? The American Data Privacy Protection Act (ADPPA) passed out of the House Energy and Commerce Committee in July 2022 with rare bipartisan support — 53-2. It seemed like a breakthrough. Then it stalled in the full House. Ironically, California's own Congressional delegation opposed it, arguing that ADPPA would preempt CCPA and weaken protections. The bill has not advanced since.

The federal privacy void persists. Congress has been trying to pass comprehensive privacy legislation since 2019. Big Tech lobbies aggressively against any law with real teeth. State delegations can't agree on preemption. The result: America has 50 different experiments in privacy law, with California as the most ambitious.


The AI Problem CCPA Didn't Anticipate

CCPA was written before the ChatGPT moment. Before large language models. Before every company started feeding user data into AI training pipelines. The law is struggling to keep up.

The Right to Delete Fiction

CCPA gives you the right to request deletion of your personal information. Companies must comply within 45 days.

But what happens when your personal information has already been used to train an AI model?

OpenAI, Google, and Meta have all incorporated vast quantities of user-generated content into their training data. That content includes personal information — names, email conversations, personal disclosures in forum posts, location check-ins, health queries. Once that data is encoded into model weights, deletion becomes technically impossible. You can delete your account. The model trained on your data remains.

CPPA is actively working on this question. But the technical reality outpaces the legal framework: you cannot unlearn an LLM.

Automated Decision-Making

CPRA added rights around automated decision-making: the right to opt out of profiling used for significant decisions, and the right to human review. CPPA released draft rules for automated decision-making in September 2024.

This matters enormously. AI systems now make or inform decisions about:

  • Credit and loan approvals
  • Insurance pricing and eligibility
  • Hiring and candidate screening
  • Rental application approvals
  • Medical triage and resource allocation

The CPRA rules would require companies to conduct risk assessments before deploying such systems, disclose when automated decision-making is being used, and provide opt-out mechanisms. Tech industry lobbying against these rules has been intense — the Chamber of Commerce, TechNet, and major platform companies have all submitted comments arguing the rules would "stifle innovation."

The same argument was made against seatbelts.


What CCPA Actually Changed (And What It Didn't)

Let's be honest about the impact.

CCPA made privacy policies longer. Not necessarily more transparent — just longer. The average consumer reads zero percent of their privacy policy. The legal disclosure that company X shares your data with 247 advertising partners, buried in page 34 of a 40-page document, is technically compliant and practically meaningless.

CCPA created an entire industry: consent management platforms. OneTrust (valued at $5.7 billion in 2021), TrustArc, Osano, Usercentrics — companies whose entire business model is helping other companies comply with privacy laws. The compliance industry may be extracting more value from privacy regulation than consumers are.

What CCPA genuinely changed:

  • Cookie banners became ubiquitous (though often dark-pattern'd)
  • Major companies built "Do Not Sell My Personal Information" links (legally required)
  • Data broker opt-out requests became possible, if difficult
  • GPC became a legally enforceable opt-out signal (at least in California)
  • The Sephora case demonstrated that enforcement would happen

What CCPA didn't change:

  • The fundamental business model of surveillance capitalism
  • The data broker ecosystem processing thousands of data points per person
  • The collection of data from AI interactions
  • The use of personal data to train foundational AI models
  • The corporate calculation that compliance costs less than the data is worth

The Coming Battle

CPPA's enforcement pipeline is growing. In 2024, it launched formal investigations into:

  • Retail data practices (loyalty programs as data collection machines)
  • Streaming platforms (viewing history, behavioral profiling)
  • HR and employment platforms (worker surveillance, AI hiring tools)
  • Data broker compliance with deletion requests

The AI/automated decision-making rulemaking is the most consequential: if California successfully regulates how AI systems can use personal data and make decisions, it will create a de facto AI privacy standard for the US market — just as CCPA created a de facto data privacy standard.

Big Tech knows this. The lobbying against CPPA's AI rules is the same fight as the lobbying against CCPA itself was in 2018. The stakes are higher now.


What You Can Actually Do

Under CCPA/CPRA, if you're a California resident:

  1. Submit data requests: Major data brokers — Acxiom, LexisNexis, CoreLogic, Epsilon — must respond to deletion requests. It's tedious but real. Services like DeleteMe ($129/year) automate this.

  2. Enable GPC: Install the GPC extension (privacytests.org lists compliant browsers) or use Brave Browser. Companies receiving your GPC signal are legally required to honor it.

  3. Opt out of sale: Every California-covered business must have a "Do Not Sell or Share My Personal Information" link. Use it.

  4. Correct your data: Credit bureaus, data brokers, and major platforms now have correction mechanisms under CPRA. Your data profile is almost certainly inaccurate — wrong income, wrong household size, wrong health status. These inaccuracies can affect your credit, insurance pricing, and targeted content.

  5. Scrub before you prompt: Your AI interactions are data. When you type your health symptoms, financial situation, or personal relationships into ChatGPT, that becomes training data — potentially forever. Conclusion: A Floor, Not a Ceiling

CCPA is imperfect. Its enforcement is underfunded, its loopholes are real, and it was outdated the moment AI systems began ingesting user data at scale. The $7,500 maximum intentional violation fine is a parking ticket for companies running billion-dollar surveillance operations.

But CCPA is also the best consumer privacy law America has ever passed. The fines are real. The precedents are being set. The CPPA is investigating. Thirteen states have followed California's lead.

The absence of federal law is a policy failure of historic proportion — the most consequential technology companies in human history operating without a unified privacy framework while every other developed nation moves forward. Europe has GDPR. Brazil has LGPD. Japan has APPI. Canada has PIPEDA. America has patchwork.

Californians voted twice — in 2018 and 2020 — to protect their own privacy when their elected federal representatives wouldn't. The result is a state law doing the work of a federal one.

The AI era makes this gap more dangerous, not less. Every chatbot interaction, every AI-generated health recommendation, every algorithmic hiring decision is processing personal data at a scale CCPA's authors couldn't imagine. The laws are running behind the technology.

Until they catch up: the only reliable privacy protection is not giving the data away in the first place.
