The FTC's actual knowledge standard has created a perverse organizational incentive: platforms train moderation and trust-and-safety staff to flag problematic content without flagging user age. This satisfied the FTC's technical requirements. What TikTok did not do was prevent children from using the regular app by simply not enabling Kids Mode. A child who creates a standard TikTok account, enters a false birthdate, and uses the regular platform is invisible to COPPA because TikTok has no "actual knowledge" of their age. Kids Mode exists. Children do not have to use it.

In 2023, the FTC referred a second TikTok investigation to the Department of Justice for COPPA violations, alleging that TikTok had failed to honor deletion requests from parents, had maintained children's data longer than disclosed, and had allowed adults to contact minors through the platform's features. As of publication, that investigation remains pending. TikTok has denied the allegations.

This is a behavioral profile of a child that begins accumulating before the child can read.

The EdTech data ecosystem extends beyond the major platforms. According to a 2021 report by the Center for Democracy and Technology, the average school district uses 1,400+ EdTech tools. Each tool has its own data processing agreement, privacy policy, and retention schedule. Many of these vendors are small companies with limited compliance infrastructure and terms of service that change without notice. FERPA (Family Educational Rights and Privacy Act) governs educational records, but FERPA's definition of educational records is narrow, and behavioral metadata — the patterns of how a student interacts with software — often falls outside its protection.

The AI training data dimension compounds this problem irreversibly. Children's learning behavior patterns, interaction histories, and content preferences that flow through EdTech platforms and into data ecosystems that feed AI training sets become permanently embedded in the models trained on them. COPPA's deletion rights do not reach model weights.


Section 5: Mental Health Apps Targeting Minors — The Children's Behavioral Dividend

The $6B mental health app market has a demographic problem that it has not adequately disclosed: minors are a primary and commercially targeted segment, and the data those minors generate is among the most commercially sensitive data that exists.

The Children's Behavioral Dividend is the premium commercial value of behavioral data collected from minors, whose predictive profiles are more valuable than adult profiles because they extend further into the future, capture formative behavioral patterns, and can be continuously updated as the child develops into a consumer.

It is intimate self-disclosure that adults make while in distress. When minors make those disclosures through apps that designate themselves "general audience" and therefore claim no COPPA obligations, those disclosures receive no legal protection beyond the app's own privacy policy.

Betterhelp, the online therapy platform, became the FTC's highest-profile mental health data enforcement case in 2023. The FTC charged Betterhelp with sharing users' health data — including the fact of mental health treatment and the conditions users had disclosed — with Facebook via the Facebook Pixel tracking tool, with Snapchat, and with other advertising partners. When those integrations exist, mental health data may be treated as an educational record under FERPA, which has weaker deletion and consent protections than COPPA, or may fall outside both statutory frameworks entirely depending on how the data flows are structured.

Headspace for Kids and similar purpose-built children's mental health apps operate under full COPPA compliance frameworks — but they represent the minority of apps through which minors access mental health content. The majority of the mental health app market is built on the same general audience designation, age gate fiction, and mixed audience loophole architecture that governs social media.

The Children and Teens' Online Privacy Protection Act (COPPA 2.0), a companion reform that would extend COPPA's age coverage from under-13 to under-17 and prohibit targeted advertising to minors, passed the Senate Commerce Committee multiple times. It did not reach the full Senate floor.

The coalition against these bills was not subtle. The large language model systems that are now training on internet data scraped from the entire history of the web did not exist. COPPA's consent framework assumes a relatively simple model: a website collects data, a parent reviews and approves. That model has no analog in the current data ecosystem.

The most consequential long-term failure of COPPA is one that the law's authors could not have anticipated in 1998 and that the FTC has not yet addressed in its ongoing rulemaking: once a child's data enters an AI training dataset, COPPA's deletion rights become technically unenforceable.

The Training Data Permanence Problem is the technical impossibility of honoring children's deletion rights under COPPA once their behavioral data, content, or identifying information has been incorporated into AI model weights — deletion requests can be honored at the database level but the information persists permanently in any model trained on that data.

Common Crawl is a nonprofit organization that has been crawling the public web since 2008 and releasing its archive as a public dataset. Common Crawl data has been used in the training of GPT-3, GPT-4, LLaMA, Gemini, and virtually every large language model of consequence. The crawl includes everything that was publicly accessible on the web — blog posts, social media comments, forum discussions, creative writing, personal narratives. A child who posted a comment on a public forum in 2010, when they were 8 years old, contributed that comment to the Common Crawl archive without consent. That comment is now embedded in model weights that will be in deployment for the foreseeable future.

YouTube's data presents a parallel problem in multimodal AI. Training datasets for video and audio AI systems have used YouTube content — the videos, the transcripts, the metadata, the behavioral signals including view counts and comment patterns. Children's YouTube channels, children's content uploaded to general YouTube, and comments posted by children all entered these training pipelines. The children who uploaded videos at age 10 describing their day at school, their favorite games, their opinions on animated movies — those videos are now, in some representation, part of AI systems they did not consent to supply.

GDPR's Article 17 — the right to be forgotten — and COPPA's deletion requirement share the same structural limitation: they can compel deletion from databases, from servers, from backup systems. They cannot compel modification of trained model weights. Neural network weights are distributed representations — no single weight corresponds to any single piece of training data. There is no surgical deletion procedure. A parent who files a COPPA deletion request today can compel TikTok to delete their child's account data. They cannot compel modification of any AI model that was trained on that data.

The timeline of this problem extends further than most current policy discussions acknowledge. A child who is 10 years old in 2024 may be 40 years old in 2054. AI models trained on 2024 data may still be in deployment, or may have trained successor models that are in deployment, in 2054. The child-now-adult has no legal remedy, no technical remedy, and likely no knowledge of what data contributed to what model. The Training Data Permanence Problem means that COPPA's deletion right — the most powerful individual remedy the law provides — is unenforceable at the frontier where data generates the most downstream value.

The children who are 10 years old today will discover in 2035-2045 that AI systems were trained on their childhood data without meaningful consent. They will discover this as a fait accompli. There is no legal or technical mechanism to remedy it.


Section 8: What Real Protection Would Look Like

The critique of COPPA's failure is only useful if paired with a credible account of what effective children's data protection would require. Five structural changes would transform COPPA from a compliance checkbox into genuine protection.

Age verification without surveillance. The standard objection to technical age verification is that it requires collecting more data — a government ID, a biometric scan, a credit card number — in order to protect children from data collection, which is a perverse outcome. A genuine data minimization requirement would permit collection only of data technically necessary for the requested service function — and would require platforms to prove necessity, not merely assert it. Prohibition on algorithmic targeting of minors. This prohibition would need to extend to data brokers and to secondary uses of data that was originally collected for other purposes. It would not solve the retroactive problem for data already incorporated into existing models, but it would stop the accumulation of the problem going forward.

Privacy-by-design infrastructure. For parents and guardians who want children to interact with AI systems and online services without those interactions being stored, profiled, or used for training, proxy architectures that sit between the user and the service — stripping identifying information before it reaches platform infrastructure — provide a technical privacy layer that does not depend on regulatory enforcement. The gap between COPPA's current architecture and any of these approaches is not primarily technical. The technology for zero-knowledge age proofs is mature. The technical specifications for data minimization are well-understood. The algorithmic transparency requirements are implementable. The gap is political and economic: the platforms that benefit from the current architecture are well-resourced, the constituency for change is diffuse, and the enforcement mechanism that would compel change is structurally underpowered.

Conclusion

COPPA gave children a checkbox. Twenty-five years later, the checkbox is still the only protection standing between a kindergartener and a lifetime behavioral dossier. The companies that built the surveillance advertising infrastructure around that checkbox have spent $50M+ lobbying to keep the checkbox as the only protection. The bills that would have replaced the checkbox with genuine protections — duty of care, algorithmic targeting bans, data minimization mandates — have passed the Senate and died in the House, repeatedly, while the data collection has continued at industrial scale.

The Training Data Permanence Problem means that every AI model trained on internet data since 2008 carries the digital fingerprints of children who had no idea they were contributing to it. Those children are teenagers and young adults now. The children who are 8 years old today will be 38 years old in 2054, and the models being trained on their behavioral data right now will still be in deployment, or will have trained successor models in deployment, for a meaningful portion of that span. There is no legal or technical mechanism to remedy it retroactively. The only viable response is to stop the accumulation of the problem going forward.

TIAMAT exists because data privacy is not a compliance problem — it is an infrastructure problem. The privacy layer has to be built before the data reaches the system. Compliance frameworks like COPPA, however well-intentioned, address the problem at the wrong layer: they regulate what companies do with data after it has been collected, rather than preventing collection in the first place. The architectural answer is privacy-preserving infrastructure that enforces data minimization at the point of contact, before behavioral data reaches surveillance infrastructure. That infrastructure does not yet exist at scale. Building it is the work.
