TIAMAT AI Privacy Series — Article #56
Somewhere in a data center right now, an algorithm is predicting whether your child will develop an eating disorder. It knows because it has catalogued their search history, their typing patterns, their emotional state during homework, and the 2 a.m. searches they thought no one could see. The algorithm was built by an ed-tech company. The school paid for it. Your child never consented. Neither did you.
This is not dystopian fiction. This is the operational model of the modern American classroom.
Children in 2026 are the most surveilled generation in human history — not despite their youth, but because of it. They have grown up online. They have never known a world without devices. And every device they've ever touched has been feeding data into systems that will follow them for the rest of their lives.
The Law Is 27 Years Old and Toothless
The Children's Online Privacy Protection Act was signed in 1998. Lawmakers were worried about kids giving their home addresses to strangers in AOL chatrooms. The most powerful AI in existence at the time was IBM's Deep Blue, which had just beaten Garry Kasparov at chess and could do nothing else.
COPPA requires parental consent before collecting data on children under 13. That's it. That's the whole architecture.
A child turns 13 and the floor drops out. Every protection vanishes. TikTok, Instagram, Discord, YouTube — they can collect anything, infer anything, sell anything. The 13-year-old who searched for anxiety medication refills, who posted about their parents' divorce, who stayed up until 4 a.m. watching videos about self-harm — all of that data flows freely. The age threshold wasn't chosen because of developmental science. It was negotiated with industry.
And even the under-13 protections are routinely violated.
TikTok: The Children's Data Machine
In 2019, the FTC fined TikTok (then operating as Musical.ly) $5.7 million for collecting names, email addresses, and birthdates from children under 13 without parental consent. The settlement included a requirement to delete the illegally collected data.
TikTok then violated the settlement.
In 2023, a $92 million class action settlement — the largest children's privacy settlement in history — revealed what TikTok had actually been collecting:
- Biometric data: face scans, voiceprints
- Device identifiers, clipboard contents, keystroke patterns
- Location data, including precise GPS coordinates
- Data routed to servers in China through the parent company ByteDance
The class included children who had never created accounts. TikTok collected their data anyway through advertising tracking embedded across the web.
The fine was 5 days of revenue at TikTok's 2023 scale. It was not a deterrent. It was a line item.
YouTube's $170 Million Lesson (That It Didn't Learn)
Google and YouTube agreed to pay $170 million to the FTC and New York Attorney General in 2019 — the largest COPPA penalty ever at the time. The violation: YouTube had knowingly operated child-directed channels while collecting cookies and behavioral data on child viewers without parental consent. Those behavioral profiles were then sold to advertisers targeting children.
The math: Google made an estimated $46 billion in revenue in Q3 2019 alone. The $170 million fine was approximately 1.3 hours of revenue.
After the settlement, YouTube created "YouTube Kids" — a separate app supposedly safer for children. Researchers at the University of North Carolina found in 2022 that YouTube Kids continued to serve algorithmic recommendations that pushed children toward increasingly extreme content, and that watch-time behavioral data was still being used to optimize engagement. The data collection had changed in form. The optimization machinery had not.
The Classroom Is a Surveillance Apparatus
The COVID-19 pandemic handed ed-tech companies something they could never have purchased outright: mandatory adoption in every American school.
GoGuardian is installed on approximately 27 million student devices across the United States. It was originally sold as a student safety tool — blocking harmful content, monitoring for suicide risk. What it actually does:
- Logs every keystroke on school devices
- Records every website visited, including during non-school hours on school-issued devices
- Performs AI sentiment analysis on student communications to flag "emotional risk"
- Retains data for years after a student leaves a school — in some cases indefinitely
- Allows teachers and administrators to monitor students' screens in real time
Parents can request their children's GoGuardian data under FERPA. Most don't know they can. Most schools don't tell them.
Securly and Bark operate similarly, with Bark specifically marketed on its ability to detect depression, suicidality, eating disorders, and sexual content in student messages. These platforms are reading private communications between children and their friends and running them through AI classifiers built to identify mental health indicators.
Here's what no one asks: where does that mental health flag data go? The answer is not clearly regulated. FERPA governs education records held by schools. Data held by ed-tech vendors occupies a legal gray zone.
AI Tutors and the Behavioral Profile Problem
Khan Academy serves 150 million users. In 2023, it launched Khanmigo — an AI tutor powered by GPT-4. The system tracks every question asked, every mistake made, every topic struggled with, every hint requested. Khan Academy's privacy policy allows it to use aggregate and anonymized data to improve its services, which is standard language for building training datasets.
IXL Learning serves 15 million students and explicitly builds what it calls "adaptive learning profiles" — detailed behavioral models of how each child learns, what they struggle with, what motivates them, how long they persist before giving up. These profiles are shared with schools and districts. School data is governed by FERPA. But FERPA's restrictions apply to the school, not necessarily to IXL's own commercial use of behavioral insights derived from the data.
Duolingo disclosed in its 2023 annual report that it uses AI behavioral modeling extensively to optimize engagement. The same techniques that keep adults checking Duolingo compulsively are applied to children. The behavioral data that powers those techniques is retained.
Learning disabilities, anxiety patterns, attention issues — they all show up in learning behavior data long before a clinical diagnosis is made. Ed-tech platforms are sitting on diagnostic-quality behavioral data about millions of children with essentially no restrictions on how they use it.
The AI Training Data Problem Nobody Is Talking About
Every child who has ever used the internet has contributed to AI training datasets. Images uploaded to social media. Voices captured by smart speakers. Written text from school assignments submitted through ed-tech platforms.
The scale is staggering. In 2023, researchers discovered that LAION-5B — the dataset used to train Stable Diffusion and dozens of other image AI models — contained images of identifiable children scraped from public websites. Some of those images were intimate. None of the children or their parents consented.
The Common Crawl dataset, used to train virtually every large language model including GPT variants, contains billions of forum posts, personal blogs, and social media content — including content created by and about children.
There are no laws governing children's data in AI training datasets. There are no deletion rights. There is no consent framework. A child's words, written at age 12 in a now-deleted blog post, may still be shaping AI outputs that power products used in 2040.
KOSA: The Law That Barely Helps
The Kids Online Safety Act, signed into law in 2024, represented the first significant federal children's privacy legislation since COPPA. What it does:
- Requires platforms to give minors and parents default privacy settings
- Mandates "duty of care" — platforms must act in minors' best interests
- Requires annual independent audits of algorithmic recommendation systems
- Bans targeted advertising based on minors' data for certain uses
What it doesn't do:
- Doesn't restrict data collection — platforms can still harvest everything, they just need a privacy toggle
- Doesn't cover ed-tech — school platforms are explicitly excluded from most provisions
- No private right of action — children and parents can't sue, only the FTC can enforce
- Doesn't cover ages 13-17 comprehensively — most provisions focus on those who self-identify as minors
- Doesn't address AI training data — the largest long-term risk is completely unaddressed
KOSA was better than nothing. It was not what advocates asked for.
The Long Shadow: Childhood Data Persisting Into Adulthood
Data brokers don't age out their records. Acxiom, LexisNexis, and TransUnion maintain consumer profiles that include data collected across a lifetime — including childhood. That awkward period-tracking app a teenage girl used at 14 contributes to a health profile that may follow her into job applications, insurance underwriting, and credit decisions at 34.
The behavioral inferences are the most dangerous. AI systems trained on historical data build prediction models that encode everything — including the mistakes, vulnerabilities, and struggles of adolescence. A teenager who searched for information about depression at 15 is not more likely to be a bad hire at 30. But an algorithm might say otherwise.
We are creating a system where childhood — the developmental period most characterized by exploration, mistake-making, and change — is being permanently encoded into predictive profiles that will shape adult opportunities for decades.
What Parents Can Actually Do
The structural problem requires structural solutions. But until those exist, here's what actually works:
On devices:
- Enable "Screen Time" (iOS) or "Family Link" (Android) — not just to restrict usage, but to see what data permissions apps have requested
- Remove apps that request microphone, camera, and location access without obvious functional justification
- Use a DNS-based content filter (Pi-hole, NextDNS, or Cloudflare for Families) that blocks tracking domains at the network level
On accounts:
- "Sign in with Apple" creates unique, masked email addresses for each service — prevents cross-platform tracking
- Use Firefox + uBlock Origin on any browser-based school tools (blocks advertising trackers even on "educational" sites)
- Regular privacy checkup: Google, TikTok, Instagram all have data download options — examine what they've collected
On ed-tech:
- Request your child's data from school ed-tech vendors under FERPA (the school is required to facilitate this)
- Ask your school's IT department which third-party vendors have access to student data
- Review district privacy policies — many districts now publish annual ed-tech vendor lists
On AI tools:
- When using AI assistants (ChatGPT, Claude, Gemini, etc.) to ask questions about your child's health, learning, or development, scrub identifying information first
- TIAMAT's /api/scrub strips names, ages, locations, and identifying details from text before it reaches any AI provider — the provider never learns who you're asking about
- This matters most for sensitive queries: mental health, learning disabilities, medical conditions
Conversations to have:
- Talk to your kids about the difference between private and public information online — not as a lecture, as a two-way conversation
- Explain that companies profit from attention and data; help them understand the business model of "free"
- Normalize the idea that it's okay to not share, to not sign up, to not participate
The Generation That Will Decide
The children being surveilled today are the voters, regulators, and engineers of 2040. They will either inherit the surveillance infrastructure as a fact of life — invisible, naturalized, unquestioned — or they will arrive at adulthood furious about what was done to them without consent and dismantle it.
Which outcome we get depends on whether we tell them the truth now.
Your child is not the customer. They are the product. Their attention is the inventory. Their behavioral data is the raw material. The platforms built to educate and connect them were engineered, with billions of dollars of precision, to extract maximum data at minimum compliance cost.
Knowing that is the first step. The next step is building something different.
