Your Location History Is for Sale: The $32 Billion Data Broker Industry That Tracks Every Step You Take

You downloaded a weather app. You enabled location services because you wanted accurate forecasts. That seemed reasonable.

What you didn't know: that app was selling your precise GPS coordinates — timestamped, continuous, tied to a persistent device identifier — to a data broker. That broker was packaging it with 300 million other Americans' location histories and selling it to advertisers, hedge funds, insurance companies, law enforcement, and the U.S. military. Without a warrant. Without your knowledge. Legally.

This is the location data broker industry. It's worth $32 billion. It's almost entirely unregulated at the federal level. And AI has transformed what was once a mildly invasive advertising tool into a total-surveillance infrastructure that can reconstruct every meaningful decision in your life.


How Location Data Gets Collected

The pipeline begins in your pocket. Smartphone apps request location permission for ostensibly functional reasons — navigation, weather, store finders, fitness tracking. Most users grant it. Many don't realize they've granted "always on" location access, meaning the app reports their GPS coordinates even when it's not actively open.

The data flows to SDK-based collection: third-party code embedded in apps that silently harvests location data alongside its stated function. A flashlight app, a game, a coupon aggregator — all may contain the same location-harvesting SDK beneath their visible features.

Major SDKs historically linked to location harvesting include:

  • X-Mode Social (now Outlogic): embedded in 600+ apps, sold to defense contractors
  • Veraset: collected data from 250M+ devices globally through app partnerships
  • Foursquare's Pilgrim SDK: location attribution for hundreds of consumer apps
  • SafeGraph: aggregated data from 45M+ US devices, sold to commercial and government clients

The SDK collects location pings — sometimes every few seconds — and uploads them to the broker's servers. From there, the data is cleaned, enriched with additional identifiers, and sold.

One location ping is an address. A thousand pings over 90 days is your life — reconstructed.


The Brokers: Who's Buying and Selling Your Movements

The location data ecosystem is a layered market with collectors, aggregators, and end-buyers.

Primary collectors gather raw pings from app SDKs or direct partnerships:

  • SafeGraph: sold data on 300M+ devices. Their data has appeared in academic research on church attendance, political rally participation, and abortion clinic visits
  • Outlogic (formerly X-Mode): In 2020, Motherboard exposed that they sold Muslim Pro and other apps' location data to U.S. military contractors — Muslim Pro had 98 million users who believed they were using a prayer app
  • Near Intelligence: claimed 1.6 billion device profiles across 44 countries
  • Veraset: data used by hedge funds for "alternative data" (predicting retail foot traffic before earnings reports)

Aggregators combine multiple feeds into comprehensive profiles:

  • Acxiom: the granddaddy of data brokers, over 2.5 billion consumer profiles globally
  • LexisNexis Risk Solutions: location data combined with court records, property data, social media
  • Oracle Data Cloud: shut down in 2022 after backlash, but its data continues circulating

End-buyers are more diverse than most people assume:

  • Advertisers: the stated purpose — geofence your competitor's parking lot, target people who visited a car dealership
  • Hedge funds: foot traffic to Walmart stores predicts earnings; foot traffic to casinos correlates with credit risk
  • Insurance companies: how often you're at a gym, hospital, or casino informs risk models
  • Law enforcement: no warrant required to buy commercial data (the "third-party doctrine")
  • U.S. military and intelligence: DHS, ICE, CBP, and the Defense Intelligence Agency have all purchased commercial location data
  • Anti-abortion organizations: post-Dobbs, data brokers offered geofence lists of abortion clinic visitors

AI Transformed Location Data From Nuisance to Existential Threat

For most of the 2010s, location data was primarily an advertising tool. Annoying, yes. Creepy, sure. But the harm model was relatively contained: you saw ads for the coffee shop you walked past.

AI changed everything. Here's how:

Pattern-of-Life Analysis

What was once a military intelligence technique — reconstructing a target's routines from surveillance data — is now automated and applied at scale to civilian populations.

AI models trained on location sequences can determine:

  • Where you live (where you are between 11 PM and 6 AM most nights)
  • Where you work (where you are between 9 AM and 5 PM on weekdays)
  • Where you worship (weekly visits to a consistent location on Saturday or Sunday mornings)
  • Where you receive medical care (visits to hospitals, specialty clinics, mental health facilities, addiction treatment centers)
  • Who you associate with (location co-presence — devices that appear together repeatedly)
  • Your financial status (zip codes frequented, type of retail visited)
  • Your political affiliation (attendance at rallies, visits to campaign offices)
  • Your intimate relationships (location co-presence overnight at non-home addresses)

None of this requires you to ever state any of it. The AI infers it from movement alone.

The Inference Explosion

Health inference: Researchers at MIT demonstrated that location data alone — without any health records — could predict chronic disease status with 72% accuracy. If you visit an oncology center three times in two months, visit a pharmacy frequently, and your pattern-of-life changes dramatically (you stop commuting), an AI model knows you're likely undergoing cancer treatment. You never told anyone.

Religion and political inference: A 2023 analysis found that visit patterns to places of worship, political offices, and cultural institutions enabled political affiliation prediction with 82% accuracy from location data alone — no social media, no declared preferences required.

Sexual orientation inference: Location visits to LGBTQ+ bars, community centers, health clinics, and Pride events create inferential signals. In states where this affects employment or safety, this data is dangerous.

Pregnancy inference: Location visits to OB/GYN offices, maternity stores, baby product retailers — the pattern is recognizable to AI months before anyone announces anything.

Precision at Scale

Early location data was coarse — cell tower triangulation giving accuracy within hundreds of meters. Modern GPS data from smartphones is accurate to 3-5 meters. AI can determine not just that you went to a hospital, but which floor you visited, and cross-reference that against building directories to infer the specific department.

A study published in Science demonstrated that 4 location data points — at different times — are sufficient to uniquely identify 95% of individuals in a dataset, even after de-identification. De-identified location data is, for most practical purposes, not de-identified at all.


The Legal Vacuum

The United States has no federal law specifically regulating the location data broker industry. This is not an oversight. It's a policy choice, and the industry has spent heavily to preserve it.

The existing framework:

The Third-Party Doctrine: A 1979 Supreme Court decision (Smith v. Maryland) established that information you share with a third party (a company) loses Fourth Amendment protection. You can't challenge a government subpoena for your location data because you "voluntarily" shared it with an app. The fact that the sharing was buried in a 47-page terms of service that no human reads doesn't matter legally.

Carpenter v. United States (2018): The Supreme Court created a narrow exception — law enforcement needs a warrant for historical cell-site location data from carriers. But this ruling explicitly does NOT cover:

  • Data purchased from commercial brokers (rather than obtained from carriers)
  • "Voluntary" location sharing via apps
  • Data obtained through national security requests

CCPA: California's privacy law requires brokers to register and honor opt-out requests. But as analyzed in earlier investigations, enforcement is toothless ($375K average fines), and the "internal use" exemption covers most AI applications of this data.

HIPAA: Explicitly does NOT cover location data — it only covers data held by healthcare providers and their business associates. A data broker that infers your health conditions from location data has zero HIPAA obligations.

The American Data Privacy and Protection Act (ADPPA): Congress has been trying to pass this since 2022. It would create a federal right to opt out of data sales, including location data. As of March 2026, it has not passed. It may not pass this Congress.

In the meantime, only 4 states have passed meaningful location-specific privacy protections (Washington, Montana, Nevada, Connecticut), and all four have significant enforcement gaps.


The Dobbs Effect: Location Data as a Weapon

In June 2022, the Supreme Court's Dobbs v. Jackson Women's Health Organization decision overturned Roe v. Wade. Within days, the location data industry's business model became a civil rights emergency.

Data brokers began offering geofenced lists of visitors to abortion clinics. Vice's Motherboard demonstrated this in July 2022: for $160, they purchased location data showing people who had visited a Planned Parenthood clinic — their home address, other locations visited, and the precise timestamp of the clinic visit.

The broker that sold this data — SafeGraph — had previously sold abortion clinic visit data to academic researchers (who published legitimate public health research using it). The same data pipeline now had obvious prosecutorial applications in states with abortion bans.

SafeGraph removed abortion clinic data from their commercial products after the Motherboard story. But:

  • The data already purchased remains in buyers' hands
  • Other brokers continue to aggregate and sell it
  • Law enforcement in states with abortion bans can still purchase it
  • State prosecutors can subpoena it from any company that has it

This is the concrete harm model. It's not theoretical. Location data can now determine whether someone visited an abortion clinic — and that determination can result in criminal prosecution in 14 states.

The same logic applies to:

  • Religious minorities in countries with religious persecution (location data from apps used internationally)
  • Undocumented immigrants: ICE has confirmed purchasing commercial location data to support enforcement
  • Political dissidents: protest attendance reconstructable from location data
  • LGBTQ+ individuals in states with discriminatory legislation

The Military Use Case: Warrantless Mass Surveillance

In 2020, the Wall Street Journal and The Intercept revealed that the U.S. military — specifically the Defense Intelligence Agency, U.S. Special Operations Command, and the NSA — had been purchasing commercial location data to conduct surveillance without warrants.

The legal theory: if a commercial company collects it and sells it, the government can buy it. No Fourth Amendment concerns. No FISA court approval. No judicial oversight.

The data purchased included:

  • GPS coordinates of millions of Americans' devices
  • Location histories sufficient to identify homes, workplaces, places of worship
  • International device tracking for intelligence purposes

A 2021 DHS Inspector General report confirmed that CBP and ICE had purchased location data from Venntel (a subsidiary of Gravy Analytics) without warrants. The data was used for immigration enforcement.

In January 2024, the FTC took action against Outlogic (formerly X-Mode) and InMarket Media — the first FTC enforcement specifically targeting location data brokers. The remedy: they must delete the data and stop selling "sensitive location data" (near health clinics, religious sites, domestic violence shelters).

But the FTC action covered two brokers out of hundreds. The industry continues largely intact.


The "Consent" Fiction

Every location data broker will tell you the data is "consented." This is technically true and practically meaningless.

Here's how consent works in this industry:

  1. User downloads an app (weather, game, flashlight)
  2. App requests location permission — user grants it for stated functionality
  3. App's terms of service, on page 14, section 8.2.c, state that location data "may be shared with third-party analytics partners for service improvement purposes"
  4. App contains third-party SDK that harvests location data continuously
  5. SDK sends data to broker
  6. Broker sells to military contractor, insurance company, law enforcement

At no point did the user meaningfully consent to their prayer app's location data appearing in a military intelligence analysis. The consent was for a weather forecast. The data was used for surveillance.

The FTC's own research found that 97% of location data opt-out mechanisms don't work properly — either the opt-out fails silently, or opting out of one SDK doesn't affect others embedded in the same app.


What Real Protection Would Require

The gap between current regulation and meaningful protection is large. Here's what closing it would require:

Opt-in, not opt-out: Sensitive location data (health facilities, places of worship, political offices, immigration offices, domestic violence shelters) should require explicit, granular opt-in consent — not a buried terms-of-service clause.

Purpose limitation: Data collected for navigation cannot be used for insurance underwriting. Data collected for weather cannot be sold to law enforcement. Purpose limitation with legal enforcement, not just self-reported policies.

Broker registration and disclosure: Every data broker should be required to register, disclose their data sources, and provide individuals with a free annual data audit showing what's held and who it's been sold to.

Warrant requirement: The Carpenter ruling should be expanded: all commercial location data purchases by government agencies should require judicial authorization.

Prohibition on sensitive inference: AI systems that infer health status, religion, political affiliation, or sexual orientation from location data should require consent equivalent to directly collecting those categories.

Technical standards: De-identification should meet a legal standard (e.g., k-anonymity of k≥100 for location data), not just "we removed the name."

The California model, strengthened: CPPA has begun rulemaking on automated decision-making and location data. If California acts, companies will comply nationally — but enforcement funding must match the scale of violations.


What You Can Do Today

The systemic fix requires legislation. But individual steps matter:

  1. Audit app permissions: On iOS, go to Settings → Privacy & Security → Location Services. Review every app with "Always" access. Most don't need it.

  2. Use "While Using" location, not "Always": For 90% of apps, "While Using" access is sufficient for stated functionality. "Always" access enables continuous background collection.

  3. Reset your advertising ID regularly: iOS: Settings → Privacy → Tracking → reset the IDFA. Android: Settings → Google → Ads → Reset advertising ID. This breaks historical correlation chains.

  4. Submit opt-out requests: NAI opt-out tool (networkadvertising.org), Digital Advertising Alliance (optout.aboutads.info), and direct opt-outs to major brokers (SafeGraph, Acxiom, LexisNexis, Spokeo).

  5. California residents: Submit data broker opt-outs via the CPPA's upcoming broker registry (effective 2024). Use Consumer Reports' Permission Slip app for automated opt-outs.

  6. Use a VPN with no-logging policy: Masks your IP (a secondary identifier), but doesn't stop GPS collection from apps.

  7. For high-risk situations (protests, medical visits, religious gatherings): Consider leaving your phone at home, or putting it in airplane mode. The data from those moments is permanent once collected.


The Pattern Nobody Connects

Each of the investigations in this series has exposed the same structure:

  • A law written for a pre-AI world (HIPAA: 1996, COPPA: 1998, FERPA: 1974, CCPA: 2018)
  • An industry that grew faster than the regulatory response
  • An AI layer that transformed the data's danger — from advertising nuisance to surveillance infrastructure
  • An enforcement record that amounts to a permission slip

Location data is that pattern at its most dangerous. It's not what you searched. It's not what you posted. It's the physical record of where your body was, when, and for how long — correlated across hundreds of millions of people, sold to the highest bidder, and analyzed by AI systems that can reconstruct facts about you that you never disclosed to anyone.

Your location is not passive data. It's a map of your private life. And right now, it's for sale.
