Professional Legal Communication Standards
Legal email is held to a higher standard than any other profession. Every message is potentially discoverable, privileged, or both. Sloppy communication in law doesn't just look unprofessional — it can constitute malpractice, waive privilege, or create binding commitments.
The fundamentals: mark privileged communications clearly, never put settlement authority in email, confirm all court dates in writing, and remember that your email represents your client's interests, not just your own.
Client Intake and Engagement
Initial client communication sets expectations for the entire representation. Cover scope, fees, communication frequency, and what clients should and shouldn't do.
Example engagement confirmation: 'Dear [Client], Thank you for retaining [Firm Name] to represent you in [matter description]. This confirms our engagement as discussed: Scope: [Specific services — be precise about what IS and ISN'T covered]. Fee arrangement: [Hourly rate/flat fee/contingency with details]. Retainer: $[Amount] due by [Date]. Communication: I will update you [frequency]. For urgent matters, contact [method]. Your responsibilities: [What you need from them — documents, cooperation, avoiding discussing case]. Next steps: [Immediate actions]. Case Status Update Templates
Regular case updates prevent the number one client complaint about lawyers: lack of communication. Even a brief update saying 'nothing has changed' is better than silence.
Example: 'Dear [Client], Case Update — [Case Name/Number], [Date]. Current status: [Where things stand in plain language]. Recent developments: [What happened since last update]. For significant developments: 'Dear [Client], I'm writing about an important development in your case. [What happened — in plain language, not legalese]. What this means: [Impact on the case]. Opposing Counsel Correspondence
Correspondence with opposing counsel requires diplomacy, precision, and strategic awareness. Everything you write can be used against your client.
Example discovery request follow-up: 'Dear Counsel, I'm writing regarding outstanding discovery in [Case Name/Number]. Your responses to our [Interrogatories/Document Requests] were due on [Date] per [Rule citation]. To date, we have not received [specific items outstanding]. Court deadline communication must be precise. Missing a filing deadline can be malpractice. Document every deadline and confirmation in writing.

Legal Billing Communication
Billing communication should be transparent and preemptive. Clients who understand their bills pay them faster and complain less.
