In 1974, Congress passed the Family Educational Rights and Privacy Act in response to a specific problem: schools were sharing student records with federal agencies, insurance companies, and employers without students' or parents' knowledge. FERPA gave students over 18 — and parents of minors — the right to access, inspect, and challenge their educational records.
For 50 years, FERPA governed student records in an era of paper files, guidance counselor notes, and grade transcripts.
Then came AI tutoring platforms that track 400 data points per learning session. Proctoring software that monitors eye movements, keystrokes, and room acoustics during exams. Social-emotional learning AI that assesses children's psychological states. Data brokers who aggregate student behavioral profiles and sell them to marketers, employers, and political campaigns.
FERPA's framework didn't change. The technology around it changed everything.
What FERPA Actually Covers
FERPA protects "education records" — records directly related to a student that are maintained by an educational institution. This includes:
- Grades and transcripts
- Disciplinary records
- Enrollment records
- Financial aid records
- Special education assessments
FERPA gives students (or parents of students under 18) the right to:
- Inspect and review their education records
- Request corrections to inaccurate information
- Consent before the school discloses records to third parties
The operative word is "consent." FERPA's privacy protection is consent-based: the school needs your permission to share your records.
Except when it doesn't.
The Exceptions That Ate the Rule
FERPA contains 14 exceptions to the consent requirement. These exceptions were written for legitimate purposes: sharing records with other schools when a student transfers, reporting to state educational authorities, complying with judicial orders.
Three exceptions have become the architecture of the EdTech surveillance industry:
1. The School Official Exception
Schools can share education records with "school officials" who have a "legitimate educational interest" in the records — without student or parent consent.
The exception was written to allow teachers to access grades, administrators to check enrollment status, and counselors to review disciplinary history.
What it has become: a license for third-party technology vendors to access comprehensive student records based on a contractual relationship with the school.
Under the Department of Education's interpretation, a technology vendor qualifies as a "school official" if:
- The school has outsourced a service to the vendor that would otherwise be performed by school employees
- The vendor is under the school's direct control with respect to use of education records
- The vendor uses education records only for authorized purposes
In practice, these requirements are honored in form more than substance. Schools sign enterprise contracts with EdTech platforms. The contracts include boilerplate language about "educational purposes only" and "direct control." The vendor gains access to student records — often including behavioral data, communication logs, and AI-generated assessments — without individual consent.
The chain extends further: vendors can share data with their subcontractors, who are also deemed school officials. A single school contract can authorize data flows through a chain of five or six companies, each passing student data with no additional consent required.
2. The Studies Exception
Schools can share student data with organizations conducting studies "for, or on behalf of" educational agencies — for purposes of improving education, developing tests, or improving instruction.
The studies exception was written for legitimate educational research. It has been used to justify sharing student data with commercial analytics companies conducting "research" that primarily serves their own commercial product development.
The line between educational research and commercial product improvement is thin and contested. When an AI tutoring platform studies how students respond to different question formats — and uses that research to improve their commercial product — does the studies exception authorize sharing the underlying student data? Many companies claim yes.
3. The Directory Information Exception
Schools can designate certain information as "directory information" and share it without consent — unless students or parents opt out. Directory information typically includes name, address, phone number, email, dates of attendance, enrollment status, degrees and awards, and activities.
When students join school-sponsored platforms, their directory information often flows to those platforms automatically. Their name, email, and enrollment status establish their account. The platform now has a legitimate relationship with an identified student.
From that starting point — name and enrollment status from directory information — a platform can build comprehensive behavioral profiles through its own data collection, without triggering additional FERPA requirements. The behavioral data generated by the platform isn't an education record — it's the platform's own data about the student.
The Phantom Protection: FERPA vs. the Platforms
Here's the structural problem: FERPA governs what schools can share. It says very little about what EdTech vendors can collect on their own platforms.
When a student uses an AI tutoring platform:
- The platform logs every interaction — every question asked, every answer given, every error made, every time the student paused, every retry
- The platform builds behavioral models of the student's learning patterns, attention span, emotional responses, and cognitive strengths
- The platform may use webcam access to assess engagement through facial expression analysis
- The platform may track mouse movements, keystroke patterns, and screen behavior
- The platform may run natural language processing on student writing and communications
None of this is typically an "education record" under FERPA. The platform collected it directly from the student's interactions with its own software. The school didn't share it with the vendor — the student generated it through their use of the platform.
FERPA doesn't restrict what EdTech platforms can collect. It restricts what schools can disclose. The distinction has created a surveillance gap that the entire EdTech industry has built its business model around.
AI Proctoring: Surveillance as Educational Infrastructure
The COVID-19 pandemic pushed higher education online and created explosive demand for remote proctoring solutions. Platforms like Proctorio, Honorlock, ProctorU, and Respondus became mandatory infrastructure for millions of students.
What AI proctoring software collects:
Biometric data
- Continuous facial recognition to verify student identity
- Eye tracking to detect when students look away from the screen
- Facial expression analysis to flag "suspicious" emotional states
- Head movement detection
- Gaze pattern analysis
Behavioral data
- Keystroke dynamics (rhythm and pattern of typing, not just what is typed)
- Mouse movement patterns
- Screen recording of the entire exam
- Browser history and open tabs
- System processes running during the exam
Environmental data
- Room scans via webcam
- Audio detection of background sounds, voices, or noises
- Ambient light analysis
- Detection of other people in the room
All of this is processed by AI algorithms that assign "suspicion scores" to students. High suspicion scores trigger flags that are reviewed by human proctors — who often work in low-wage gig economy arrangements with minimal training in interpreting AI outputs.
The Algorithmic Discrimination Problem
AI proctoring systems have documented bias problems:
Facial recognition failure rates: Studies have consistently found that facial recognition accuracy is lower for darker-skinned faces. Proctoring systems that use facial recognition to verify student identity fail to recognize Black students at higher rates — resulting in false flags and exam interruptions for students who are not cheating.
Eye movement bias: Students with certain disabilities, neurodivergent students, and students who process information by looking away from the screen show eye movement patterns that proctoring AI flags as suspicious. Students with anxiety — already under exam stress — show physical signs that proctoring AI interprets as deception indicators.
Environmental bias: Proctoring systems that evaluate the "test environment" disadvantage students in crowded households, shared rooms, noisy apartments, or homes without private spaces. A first-generation college student sharing a one-bedroom apartment with four family members is automatically disadvantaged by an AI that flags background noise and unexpected people.
Accent and speech bias: Some proctoring systems with audio analysis components flag certain speech patterns and accents as unusual.
Despite documented bias, AI proctoring systems are in widespread use at universities across the country. Students who are flagged must often navigate appeals processes that assume the AI's suspicion score is meaningful evidence.
The Retention Problem
AI proctoring platforms retain exam recordings, biometric data, and behavioral profiles. The retention periods vary, but most platforms retain data for years — often tied to institutional contract terms.
A student's facial biometrics, room environment, eye movement patterns, and behavioral signature during exams may be retained by a third-party company for years after graduation. What happens to that data if the proctoring company is acquired? What happens if they suffer a breach? What happens when better facial recognition systems can be applied retroactively to old recordings?
Students are rarely informed of these risks when they're required to install proctoring software as a condition of completing their coursework.
The Student Data Broker Marketplace
One of the most underreported scandals in EdTech privacy is the existence of a robust market for student data.
Students take the PSAT and SAT through College Board. College Board sells "Student Search Service" — lists of student names, contact information, demographic data, and academic characteristics — to colleges, scholarship programs, and other organizations. Students can opt out, but the default is inclusion.
For decades, this was considered normal educational infrastructure. Colleges use it to recruit students. Scholarship programs use it to identify candidates.
The problem: the data doesn't stay in the educational ecosystem. College Board data has appeared in the commercial data broker market. ACT, Inc. has faced similar concerns. Student demographic and academic data flows from test prep companies, college application platforms, and financial aid systems into commercial data markets.
The student data broker market includes:
- Direct marketing lists: Student names and contact info sold for marketing purposes (textbooks, credit cards, student loan companies, consumer products targeting students)
- Demographic profiles: Age, location, academic level, major, enrollment status — useful for advertisers targeting student demographics
- Behavioral inferences: Interests, consumer patterns, and behavioral predictions derived from student data
- Employment-adjacent data: Academic performance indicators that flow into background check and employment screening systems
FERPA doesn't effectively restrict most of this. The data that reaches the commercial market typically flows through one of the exceptions — or was collected directly by vendors rather than shared by schools.
Social-Emotional Learning AI: Assessing Children's Inner Lives
Social-emotional learning (SEL) has become a significant sector of the EdTech market. Platforms like Panorama Education, Positive Learning Collaborative, and similar tools deploy surveys and AI assessments to measure students' emotional states, social relationships, and psychological wellbeing.
The stated goal is to identify students who need support and help schools allocate counseling resources effectively.
What these platforms actually create:
Psychological assessments without clinical oversight: SEL surveys ask students — sometimes as young as elementary school age — to rate their feelings of belonging, their relationship with their family, their experience of sadness or anxiety. These questions would require a licensed clinical professional's oversight if deployed in a medical context. In EdTech, they're administered by software.
Persistent mental health flags: When an AI system flags a student's SEL survey responses as concerning, that flag may become part of the student's school record — potentially following them through their educational career and beyond. A 10-year-old who reports feeling sad one week may have that data retained for years.
Data sharing with third parties: Panorama Education, for example, was founded by Facebook co-founder Andrew McCollum. The platform's data flows and investor relationships have raised questions about how student psychological data connects to the broader behavioral data ecosystem.
Surveillance normalization: Students who grow up with AI systems assessing their emotional states on a regular basis are being conditioned to accept psychological surveillance as normal. This is not a trivial concern.
What FERPA Enforcement Looks Like (And Doesn't)
FERPA enforcement is handled by the Department of Education's Student Privacy Policy Office (SPPO). Unlike the FTC or state AGs, the SPPO cannot issue fines. Its enforcement mechanism is the withdrawal of federal funding — which has never been invoked against any institution in FERPA's 50-year history.
The practical result: FERPA has no meaningful financial deterrent.
Compliance is assumed. Violations are addressed through guidance letters and corrective action plans. No institution has ever lost federal funding over FERPA.
For EdTech vendors — who aren't covered directly by FERPA, only their school customers are — enforcement is even more remote. The vendor may violate the terms of their school contract. The school may face FERPA scrutiny. The vendor faces no direct legal consequence.
The student whose data was improperly shared has no private right of action under FERPA. They cannot sue. They can file a complaint with SPPO, which will investigate, and may issue a letter, and will not impose a fine.
The State Law Patchwork
In the absence of effective federal enforcement, states have passed their own student privacy laws:
California (SOPIPA): The Student Online Personal Information Protection Act prohibits EdTech operators from selling student information, using it for targeted advertising, or building profiles for non-educational purposes. More protective than FERPA in key areas.
New York (Education Law Section 2-d): Requires contracts with third-party contractors to include specific privacy protections and gives the state enforcement authority.
Illinois (Student Online Personal Protection Act): Similar to California's SOPIPA, with additional protections.
Colorado, Texas, Florida: Various student data privacy laws with different thresholds and coverage.
The patchwork creates compliance complexity for EdTech companies and coverage gaps for students in states with minimal protections. A student in California has meaningfully more protection than a student in a state with no supplemental student privacy law.
And even the strongest state laws don't reach the core issue: the data that EdTech platforms collect directly from student interactions, rather than receiving from schools.
What Should Happen
The fundamental problem is that FERPA was designed to control information flow between institutions — schools and third parties. It wasn't designed for an era when the third party collects data directly from students through software that schools mandate.
What FERPA reform would require:
Extend coverage to vendors directly: Third-party EdTech vendors should have direct FERPA obligations, not just their school customers. If you collect data from students through a school-mandated platform, you're a covered entity.
Close the school official exception: Vendors should need to meet specific technical and contractual standards to qualify as school officials, with regular auditing and penalties for non-compliance.
Require meaningful consent for behavioral data: The data EdTech platforms collect through student interaction isn't covered by existing school consent — it should require specific, informed consent.
Private right of action: Students and parents should be able to sue for FERPA violations. The threat of litigation is the only deterrent that changes behavior at scale.
Biometric data prohibition: Facial recognition and biometric data collection in educational settings should require explicit legislative authorization, not a vendor contract.
For EdTech developers right now:
If you're building educational software, you're collecting data about minors — often from disadvantaged populations with limited ability to refuse participation in mandatory school technology.
- Collect the minimum data operationally necessary. Not the maximum you could collect.
- Build deletion into your data model from day one. Real deletion, not archiving.
- When you send student data to AI providers for personalization, content moderation, or safety checking — strip all identifying information first. The AI provider should receive learning patterns and behavioral signals, not names, school names, ages, or any other identifier. A privacy proxy that scrubs before forwarding is not optional infrastructure in EdTech; it should be mandatory.
- Audit your subcontractor chain. Every company in the chain that receives student data needs to meet the same standards you do.
- Don't wait for regulation. Students trusted your platform with data about their intellectual development and, increasingly, their psychological states. That trust deserves protection.
The Stakes
The students who went through K-12 in the 2010s and 2020s are entering adulthood with comprehensive behavioral profiles they didn't consent to create and can't access or delete.
AI systems making decisions about their college admissions, job applications, creditworthiness, and insurance rates may be drawing on signals derived from their elementary school learning patterns, their middle school eye movement during tests, their high school social-emotional survey responses.
FERPA gave students the right to inspect their education records. It didn't give them the right to understand how AI-derived behavioral models of their development are shaping opportunities throughout their adult lives.
That gap — between the privacy rights students have on paper and the surveillance reality they live in — is not a technical problem. It's a policy failure that has been accumulating for 20 years while EdTech companies built a $340B industry on data they were never clearly authorized to collect.
