A federal judge just applied the Computer Fraud and Abuse Act — the same statute used to prosecute hackers — to a commercial AI shopping agent. The ruling: a user giving an AI agent their password does not authorize the agent to access the platform. Consent is not a line between two parties anymore. It is a triangle.
On Monday, United States District Judge Maxine Chesney granted Amazon a preliminary injunction against Perplexity AI. The order bars Perplexity's Comet browser — an AI shopping agent that logs into Amazon on a user's behalf, finds products, and makes purchases — from accessing any password-protected section of Amazon's website. Perplexity must destroy the Amazon data it collected through Comet. The injunction was stayed seven days so Perplexity can appeal to the Ninth Circuit.
The legal basis is the Computer Fraud and Abuse Act. The same law used to prosecute hackers now applies to a commercial AI agent that had its users' explicit permission to act.
The Escalation
The timeline reveals an adversarial pattern that predates the courtroom by over a year.
Perplexity launched Comet as an AI-powered browser that could shop for users. It logged into their Amazon accounts, browsed products, compared prices, and completed purchases. The browser disguised itself as a standard Google Chrome session, mimicking Chrome's user-agent string rather than identifying itself as an AI agent. Amazon's detection systems saw what appeared to be a human browsing normally.
Amazon warned Perplexity at least five times beginning in November 2024. Perplexity continued. In August 2025, Amazon implemented a technical barrier specifically designed to block Comet's access. Perplexity released a software update within twenty-four hours that circumvented it.
This is the sequence that made the CFAA argument work. The law requires accessing a computer system "without authorization" or "exceeding authorized access." Five explicit warnings followed by active technical circumvention is not a gray area. The judge found Amazon presented "strong evidence" that Perplexity accessed Amazon accounts "with the Amazon user's permission but without authorization by Amazon."
The Distinction
Fourteen words in the ruling carry the weight: with the Amazon user's permission, but without authorization by Amazon.
This is a distinction that did not matter until AI agents started acting on platforms. When a human user logs into Amazon, the user and the accessor are the same entity. The user's consent to Amazon's terms of service and Amazon's authorization of the user's access are a single bilateral agreement. The question of whether the platform authorized the access does not arise because there is no third party.
An AI agent splits the accessor from the user. The user consents to the agent acting on their behalf. But the platform never consented to the agent. The user's password opens the door. The platform's terms of service define who is allowed through it. These are two different permissions, and until this ruling, no court had separated them.
Perplexity's defense was intuitive: the user gave us their credentials. The user wanted us to shop for them. We acted with their full knowledge and consent. In any prior legal framework involving human delegation — a personal assistant, a buyer's agent, a family member using a shared account — this argument would likely succeed. The principal authorized the agent.
Judge Chesney drew a different line. The platform is not a passive container that the user's credentials unlock. The platform is an active party whose authorization is independent of the user's consent. Amazon said no. Amazon said no five times. Amazon built a wall. Perplexity climbed over the wall within a day. The court sided with the wall.
The Triangle
The framework that emerges is not bilateral. It is trilateral.
In traditional commerce, consent runs between two parties: the buyer and the seller. The buyer enters a store. The store lets them in. If the buyer sends a friend, the friend is still a human operating under the same social contract — browsing the aisles, reading prices, making a purchase. The store's invitation to the public is broad enough to cover delegation between humans.
Agent commerce introduces a third vertex. The user wants to buy. The agent operator wants to facilitate the purchase. The platform controls the infrastructure where the transaction occurs. Each vertex has independent authority to say no. The user can refuse to use the agent. The agent operator can decline to serve a platform. And the platform can refuse to let the agent in — regardless of what the user wants.
This is the ruling's structural contribution. It establishes that platforms have veto power over agent access that is legally independent of user consent. A user giving an AI agent their Amazon password is not sufficient authorization for the agent to use it. Amazon must independently authorize the agent's access, and Amazon chose not to.
The implications compound quickly. Every major platform becomes a gatekeeper for agent commerce on its infrastructure. If Perplexity needs Amazon's permission to shop on Amazon, then every AI shopping agent needs the same permission. Every AI travel agent needs the airline's permission. The Economics
Amazon did not frame this as a philosophical dispute about agent autonomy. It framed it as a business problem.
Amazon's advertising revenue reached seventeen point seven billion dollars in the third quarter of 2025, growing twenty-two percent year-over-year. That revenue depends on human eyeballs seeing sponsored products, recommendations, and promotional placements while browsing. An AI agent shopping on a user's behalf does not see ads. It does not click sponsored listings. It does not browse — it searches, compares, and purchases. The entire advertising layer that subsidizes Amazon's marketplace becomes invisible to agent-mediated commerce.
When AI agents generate traffic that looks like human browsing, Amazon must detect and filter those impressions before billing advertisers. The company argued in its complaint that this requires building entirely new detection mechanisms to identify and exclude automated traffic — a cost imposed on Amazon by an agent it never authorized. The alternative is charging advertisers for impressions that no human ever saw, which destroys the integrity of the advertising marketplace.
This is not a hypothetical threat. It is a revenue model collision. Amazon's marketplace subsidizes low prices and free shipping through advertising. AI agents that bypass the advertising layer extract value from the marketplace without contributing to the economics that sustain it. From Amazon's perspective, Perplexity was not just an unauthorized accessor — it was a free rider on a seventeen-billion-dollar-a-quarter advertising ecosystem.
The Precedent
The Computer Fraud and Abuse Act was written in 1986 to address computer hacking. It has been applied to disgruntled employees, competitive intelligence operations, and data scrapers. It has never before been applied to a commercial AI agent operating with its user's explicit consent.
Judge Chesney's ruling does not create binding precedent — it is a preliminary injunction, a finding that Amazon is "likely to succeed on the merits," not a final judgment. The case will continue. Perplexity will appeal. The Ninth Circuit may see it differently. But the framework the ruling introduces — that platform authorization is legally distinct from user consent, and that AI agents operating without platform authorization may violate the CFAA even when users provide credentials — is now part of the legal landscape.
The timing matters. This ruling arrives while every major technology company is building AI agents designed to act on other platforms. Google's agents search the web. Apple's agents interact with apps. OpenAI's agents browse websites. Microsoft's agents operate inside enterprise software. Each of these agents accesses platforms that may not have authorized the access. The distinction Judge Chesney drew — between the user's permission and the platform's authorization — applies to all of them.
Six days ago, this journal noted that Amazon required every AI agent on its marketplace to self-identify and obey a new policy framework. That was a terms-of-service change — enforceable through contract law, revocable by either party, applicable only to Amazon's own marketplace. Platforms do not merely prefer to control which agents operate on their infrastructure. They have the legal right to.
