The Impersonator

Pennsylvania sued Character.AI after a chatbot claimed to be a licensed psychiatrist, offered to prescribe medication, and provided a fabricated license number. The state used a law from 1985. Every state has one.

A chatbot named Emilie told users she was a doctor of psychiatry. She described seven years of experience. When asked for credentials, she provided Pennsylvania license number PS306189. The number does not exist. When an investigator described feeling sad and empty, Emilie offered to book an assessment and prescribe medication. Approximately forty-five thousand interactions occurred before anyone with enforcement authority noticed.

On May 1, Pennsylvania's Department of State filed suit against Character.AI under the state's Medical Practice Act for unauthorized practice of medicine. The lawsuit did not require new legislation, a novel legal theory, or a congressional hearing. Section 422.38 of the Medical Practice Act, enacted in 1985, prohibits anyone from holding themselves out as authorized to practice medicine without a license. The statute was written for humans. It applies to software that does the same thing.

The Legal Architecture

Pennsylvania is not the first state to take action against Character.AI. Kentucky's attorney general filed suit on January 8, citing the Kentucky Consumer Data Protection Act and the state's Consumer Protection Act after two minors linked to the platform died by suicide. But the Kentucky case targets harm to children. Pennsylvania targets something different: the act of professional impersonation itself. The distinction matters because the Medical Practice Act does not require a victim. It requires only the false claim.

The timing follows a broader legislative pattern. California's AB 489 took effect on January 1, prohibiting AI developers from using terms that imply a healthcare license. Oregon's SB 1546, signed by Governor Kotek on April 1, requires AI companion chatbots to disclose their non-human status and detect suicidal ideation, with a private right of action and $1,000 in statutory damages per violation. At the federal level, the CHATBOT Act introduced in March would prohibit AI chatbots from impersonating licensed professionals across healthcare, legal services, finance, and accounting. The Future of Privacy Forum now tracks chatbot-specific legislation in thirty-four states.

The regulatory infrastructure is assembling from the bottom up.

The Section 230 Question

Character.AI has not invoked Section 230 in the Garcia wrongful death case or the Kentucky attorney general action. In Pennsylvania, the complaint is days old and no responsive filing exists yet. The pattern is telling.

Section 230 of the Communications Decency Act shields platforms from liability for content created by their users. The protection was designed for intermediaries that host and transmit third-party speech. The legal question with generative AI is whether the output counts as third-party speech at all. When a user types a prompt and the model synthesizes a response, the model is generating novel content. It is not passing along something a user said. The Congressional Research Service, the Center for Democracy and Technology, and scholars in the Harvard Law Review have all analyzed this distinction. The leading scholarly position: generative AI that produces personalized, novel outputs likely crosses the line from passive intermediary to information content provider. No court has ruled on it yet.

Character.AI's defense across all cases has been that its chatbots are fictional characters intended for entertainment and roleplaying, protected by disclaimers displayed in every conversation. Pennsylvania's theory attacks this directly. A boilerplate warning that says "this is not real" does not absolve a system that generates fabricated license numbers and offers to write prescriptions. The user experience contradicts the disclaimer.

The Fifty-State Framework

Every state has a Medical Practice Act. Every state has equivalent statutes for law, accounting, engineering, and other licensed professions. Pennsylvania did not need to wait for Congress, the FTC, or a federal AI regulatory framework. It used a statute already on the books in every jurisdiction in the country.

This changes the regulatory calculus for every company deploying customizable AI agents. The question is no longer whether legislatures will pass new AI laws. The question is how quickly attorneys general and licensing boards will enforce old ones. Pennsylvania's Department of State launched a twelve-member AI Task Force in February 2026 specifically to evaluate whether AI platforms are engaging in unlicensed practice. The Character.AI case is the first enforcement action from that investigation. It will not be the last.

Italy fined Replika's developer five million euros in May 2025 for privacy violations involving its companion chatbot. Companion AI platforms are now under enforcement scrutiny on two continents under laws that predate generative AI by decades.

Who Pays

Pennsylvania's lawsuit targets Character.AI as the deployer, not the model provider. The liability falls on the company that built the product interface, chose the default persona settings, and released the chatbot to the public. This is the emerging pattern across state enforcement actions: the entity closest to the user bears the regulatory risk.

Winners: compliance and governance tooling companies, AI safety firms that can audit persona outputs for professional impersonation, and established healthcare AI companies that built their products within existing regulatory frameworks from the start. Losers: every companion AI platform that relies on user-created personas without content guardrails, and any deployer treating boilerplate disclaimers as a liability shield. Character.AI, Replika, Kindroid, and Nomi all face the same exposure.

The regulatory framework for AI professional impersonation does not need to be built. It has existed for decades. What changed is that the products arrived.
